Court rules Josephine Kabura, 4 others have case to answer in Sh791mn NYS corruption case

NAIROBI, Kenya, Oct 17 – A Nairobi Court has ruled that businesswoman Josephine Kabura and four others have a case to answer in the Sh791 million National Youth Service (NYS) corruption case.

Trial magistrate Wendy Micheni on Monday ruled that they will now have to defend themselves in the case facing them.

She however set free former NYS Director General Nelson Githinji, former Principal Secretary Peter Mangiti, businessman Ben Gethi and others in the graft case.

Micheni ruled that the prosecution failed to produce enough evidence linking them to the theft.

The magistrate further noted that the prosecution relied on general information which was not backed up by both electronic and documentary evidence.

“Having failed to establish a prima facie case against the accused persons, i hereby acquit them for lack of evidence ,”the magistrate ruled.

In the case the Prosecution called more than 50 witnesses to testify against Magiti and others.

In 2015, the accused persons denied the charges of conspiracy and theft of the money.
