Court stops JKIA from entering into any contract with Adani

NAIROBI, Kenya, Nov 27 – The High Court has halted Jomo Kenyatta International Airport (JKIA) from entering into any contract or concession agreements with the Adani Group.

Justice Bahati Mwamuye ordered that no such agreements should proceed pending the determination of petitions challenging the purported public-private partnership between the Government of Kenya and the Adani Group.

The Judge further directed the Adani Group and Adani Airports Holdings Limited to submit documentation confirming the announcement by President William Ruto during his State of the Nation address, which stated that the concession had been cancelled.

Additionally, the Treasury Cabinet Secretary, Ministry of Roads, JKIA management, and the Kenya Airports Authority have been instructed not to enforce any aspect of the partnership.

The court’s decision follows a petition by Tony Gachoka, represented by a team of senior counsels including Kalonzo Musyoka, Kibe Mungai, Eugene Wamalwa, Dan Maanzo, and Ndegwa Njiru. The lawyers argued that Kenyans deserve clarity on how the Adani Group was introduced to Kenya, alleging corruption in awarding the contract.

They also contended that President Ruto’s announcement of the cancellation is insufficient without supporting documentation. This, they noted, is critical given allegations of a $265 billion corruption scandal involving Adani in the United States.

Justice Mwamuye directed all respondents to file and serve relevant documentation, with the matter set for mention on January 29, 2025, for further directions.
