Second petition challenging increase in passports, ID cards, birth, marriage, death certificate fee filed in court

NAIROBI, Kenya, Nov 14 – A second petition has been filed at Milimani high court seeking to quash a gazette notice published by the Ministry of Interior pronouncing increment of fees and levies on passports, Identity cards, birth, marriage and deaths certificates.

The petitioner Fredrick Bikeri says the publication of the gazette notice dated November 6 2023 was in breach of several articles of the constitution.

The aggrieved applicant through his lawyers Shanice Maingi and Danstan Omari told journalists at Milimani law court that at the hearing of the petition, they will demonstrate to the court that the Ministry acted unlawfully by publishing the gazette notice.

They said there was no public participation as required by law before the new levies and fees were pronounced.

They said the increase of fees from Sh100 to Sh1000 is on the high scale and most Kenyans would not afford and more so those finishing their secondary education and require the IDS for Job seeking and further studies.

“Over 2M children will be graduating this year and will require passports to travel outside the country for further studies and looking for employment and will not afford the fee being charged for passports,” they said

When the petition was placed before Justice Lawrence Mugambi he directed that the same be served to Interior CS Kithure Kindiki and the Attorney General Justin Muturi and the same be mentioned together with the earlier petition for directions.
