NAIROBI, Kenya, Feb 17 — The Supreme Court has struck out Jimi Wanjigi’s appeal challenging former IEBC Chairperson Wafula Chebukati’s decision to disqualify him from last year’s presidential race.
Wanjigi had moved to the Supreme Court after the Court of Appeal upheld the decision by the Independent Electoral and Boundaries Commission (IEBC) to disqualify over inadequate signatures and failure to present academic papers.
The Supreme Court held that constitutional issues had been considered by the superior courts below, noting that the apex court only handles issues on interpretation and application of the Constitution.
“The Supreme Court is not an open forum for all cases from the appellate court on judicial review matters,” the Court stated in a ruling on Friday.
The Safina Party presidential aspirant had argued that he is a degree holder by virtue of having completed his course work at the Daystar University.
He contended that his impending graduation could not constitute a conclusion that he does not hold a degree.
Wanjigi was locked out alongside Thirdway Alliance’s Ekuru Aukot and Reuben Kigame.
Aukot and Kigame were both disqualified for presenting insufficient signatures in support of their bids.
