Defence to Seek ‘No Case to Answer’ Ruling in Maxine Wahome Murder Trial

Wahome, who has faced the charge since 2022, is accused of causing Khan’s death following an incident at her Kilimani apartment.

NAIROBI, Kenya, Nov 27 – The defence team representing rally driver Maxine Wahome is set to file a no-case-to-answer submission, signaling a bid to have her acquitted without being placed on her defence after nearly three years on trial for the alleged murder of rally driver Assad Khan.

Wahome, who has faced the charge since 2022, is accused of causing Khan’s death following an incident at her Kilimani apartment.

The prosecution closed its case recently after calling 29 witnesses, including medical experts, detectives, scene-of-crime officers, and civilian witnesses.

Her legal team, led by Senior Counsel Philip Murgor, is expected to argue that the evidence presented does not sufficiently link Wahome to Khan’s death or meet the threshold required to put her on the defence.

If successful, the application could see the court rule that the prosecution failed to establish a prima facie case — effectively clearing Wahome of the murder charge.

However, if the court finds otherwise, Wahome will be placed on her defence to respond to the evidence presented.

The ruling on the application will mark a critical stage in one of the country’s most closely watched criminal trials in recent years.
