10 years for man who sodomised dad

WUNDANYI, Kenya, May 12 – A middle aged man in Taita Taveta has been jailed for 10 years after being convicted of sodomising his ailing father.

Joseph Mwamburi Kapanga was found guilty by Wundanyi Resident Magistrate K I Orenge, in a case that shocked the area villagers.

The accused had earlier denied the offense but later pleaded guilty. The prosecutor, Chief Inspector Sammy Ombogo had charged that Mr Kapanga had on diverse dates in February this year at unknown times at Wesu market in Wundanyi division had carnal knowledge of Darius Kapanga Kirigha against the order of nature.

The prosecution told the court that the complainant was at his house with his wife when the accused who is his son came and threatened to kill his mother.

“I was at Wesu sleeping when the accused came to my room and sodomised me. I suffer from stroke and my daughter Fiona came and found my son in the act and screamed,” Mr Kirigha told the packed and attentive courtroom.

“I have been sick for 14 years and I did not know what the accused did to his wife,” the complainant told the court. The accused came at night and covered my mouth using a white cloth and sodomised me again.”

Mr Kirigha’s wife is the one who took her husband to hospital where he was examined and found to have been sodomised, the court heard.

The matter was reported to the Wundanyi Police station and the accused was arrested and charged.

In his ruling, the magistrate said the offense committed was very serious considering that it was committed against the father of the accused who was sick and bedridden.

Mr Kapanga was given 14 days to appeal against the sentence.
