NAIROBI, Kenya, Apr 30 – The High Court has overturned a decision by the Political Parties Disputes Tribunal reinstating Amani National Congress lawmaker Geoffrey Osotsi to the party.
The ruling followed a Judicial Review application by the Musalia Mudavadi-led party which challenged the tribunal decision citing lack of jurisdiction.
Justice John Mativo overturned the tribunal’s ruling saying Osotsi had not exhausted mechanisms provided for under the Political Parties Act before lodging a compliant at the tribunal.
ANC had told the court it gave Osotsi a chance to defend himself before party organs but the lawmaker declined.
In a separate civil appeal, Lady Justice Cecilia Githua dismissed a petition challenging the appointment if Barack Muluka as the party’s Acting Secretary General following the ouster of Osotsi.
Githua ruled that the Political Parties Disputes Tribunal had no jurisdiction to entertain the matter filed by Anjela Gathoni and Ibrahim Memba.
