Evolving tax policies pose challenges for Judiciary: Judge Mabeya

NAIROBI, Kenya, Sep 20 – Justice Alfred Mabeya, Presiding Judge of the Milimani High Court Commercial & Tax Division, has warned that evolving tax policies and emerging economic realities pose significant challenges for judicial officers in delivering informed judgments.

Mabeya emphasized the importance of judicial officers having a strong understanding of tax and economic matters to ensure accurate and fair adjudication of court cases in line with the law.

The judge spoke at the ongoing Judicial Dialogue on Emerging Issues in Adjudication of Tax Disputes that is hosted by the Kenya Revenue Authority (KRA) and the Kenya Judiciary Academy (KJA) in Nakuru.

The workshop brings together experts from both the public and private sectors, including the judiciary, legal fraternity, tax experts, the banking sector, and OXFAM, among other stakeholders

“The weeklong engagement marks a significant milestone in the enduring partnership between the KRA and the Judiciary,” the KRA announced in a statement.

“It serves as a preeminent platform for knowledge dissemination, capacity building, and fostering a nuanced understanding of intricate tax issues among Kenya’s judicial officers.”

KRA Commissioner General Humphrey Wattanga reaffirmed the agency’s commitment to tax education and awareness, emphasizing the judiciary’s critical role in interpreting and enforcing tax laws and acknowledging the significant impact of their decisions on the country’s socio-economic landscape.

“Our central mission is to disseminate knowledge and empower our esteemed judges with the right information. We comprehend that informed decisions are the cornerstone of justice, and we are steadfast in our commitment to providing the requisite information and insights,” Wattanga said.
