DPP terminates case against Moroccan firm OCP (K), in substandard fertilizer scam

, NAIROBI, Kenya, May 9 – The Director of Public Prosecutions (DPP) Noordin Haji has terminated the case against Moroccan fertilizer firm OCP (K) and four of its officials in the substandard consignment scam.

He further ordered that the investigating officer to unconditionally release the impounded consignment of fertilizer held at Ballore Warehouse to OCP (K) limited.

According to Senior Assistant Director of Public Prosecution Alexander Muteti, the decision was arrived after parties entered a plea bargaining agreement.

He told Chief Magistrate Kennedy Cheruiyot, that criminal charges against the five, Benson Oduor Ngesa, Karimi Nhadji, Malika Kirama, Youne Addi and OCP (K) limited have been withdrawn forthwith.

Muteti further told the court that the DPP has also withdrawn the application seeking the disqualification Senior Counsel Paul Muite from appearing in the matter.

Muite was on record, representing the five accused persons.
