NAIROBI, Kenya, Jan 3 – The High Court has issued new orders revoking the appointment of Kungu Mungai as the Chairman of the Kenya Cultural Centre Council following a petition filed by David Njoe Kinthuka.
The court declared that Muigai’s appointment to be the Chairman of the Board for a period of two years, with effect from the 20 th January 2023, is invalid, null and void.
“An order is hereby issued quashing the appointment of Capt. Kungu Muigai, to be the Chairman of the Board of the Kenya Cultural Centre Council, for a period of two (2) years, with effect from the 20 th January, 2023,” read the court statement.
In his Petition the petitioner challenged the validity of Mungai appointment in the position stating that his appointment contravenes Section3 of the Kenya Cultural Centre Act on the council mandate to handle appointments.
He argued that Muigai’s appointment to the position was done by the then Youth Sports and Culture Cabinet Secretary and was not subjected to public participation process.
“A declaration that the 1 st Respondent action of appointing the Capt. Kungu Muigai as the Chairman of the Kenya Cultural Centre Council with effect from 20 th January 2023 is an arbitrary act that contravenes Section 3 (3) of the Kenya Cultural Act,” it added.
The court directed that the Kenya Cultural Centre Council shall therefore elect its Chairman in accordance with Section 3 (3) of the Kenya Cultural Centre Act.
