    Am just wondering, are some of the so called witnesses prisoners of the OTP? Are they free to exit the cases if they want to without inducement? Was Besouda right to openly threaten them with jail should they attempt to withdraw? Is there a platform or support for those who wish to with draw on own accord or feels they were coerced to give evidence by the then political climate?
    Barasa case is a ploy to terrify any Kenyan wishing to practice constitutional rights to freedom of expression, speech etc, no one, even parliament, seeks to find the condition or how free are the OTP witnesses. I pray that none of them are involuntary prisoners and do not have a way out.

      Good observation. The witness money is not coming without strings attached. If they don’t tow the line of OTP they will be mistreated and discarded in the Netherlands or other foreign land. Its not fun to be in a foreign country where u have no freedom of your own.

        Can a lawyer somewhere enlighten us how the ICC system avails the rights and freedoms of the witnesses (if any) and how it enables them access to these rights if available under Rome Statute?

      It is a great cause for concern. I doubt whether the Kenya Government has been informed how many citizens as “witnesses” have left the country and where they have gone. The most worrying thing is that a few years down the line, some of them will start coming back home and then we shall start hearing all sorts of weird stories we never imagined.

      It seems like we dont or didnt have competent law makers in Kenya coz we all seem shocked and almost submissive to what is happening. Didnt any of our big lawyers see this coming and are they seeing any more surprises on the way or will we wait to be surprised at the obvious over and over again? The ICC is one big hole we dug up ourselves and pointing fingers at this point in time is useless.
