On Thursday, Principal Magistrate H. M. Nganga awarded musician Nonini, legally known as Hubert Nakitare, Ksh4 million in a copyright infringement case involving an influencer and a television manufacturing company.
The case centred on a social media video that featured a portion of Nonini’s song We Kamu without his consent. The video, created by influencer Brian Mutinda, was reposted by the company, leading to the lawsuit. Nonini claimed that the unauthorized use of his music caused him financial loss and harm.
The court, delivering the ruling via Microsoft Teams, found the defendants liable for infringement and ordered them to pay Ksh4 million in general damages. However, the magistrate denied Nonini’s request for aggravated and punitive damages, citing insufficient grounds.
The compensation was based on what the defendants would have paid in licensing fees for the authorized use of the song.

As reported by The Sauce back in March of 2023, Nonini had been awarded Ksh.1 million in general damages for copyright infringement and Mutinda was directed to pull down the unauthorized video from his social media platforms.
