Did the Court cancel the health system?<\/strong><\/h3>\n\n\n\n<p>No.<\/p>\n\n\n\n<p>The Court did not cancel:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Social Health Insurance Fund (SHIF)<\/li>\n\n\n\n<li>The Integrated Healthcare Information Technology System (IHITS)<\/li>\n<\/ul>\n\n\n\n<p>Instead, it allowed both to continue because millions of Kenyans are already using them.<\/p>\n\n\n\n<p>The judge warned that cancelling them would cause a healthcare crisis.<\/p>\n\n\n\n<p>READ: <a href=\"https:\/\/www.capitalfm.co.ke\/news\/2026\/03\/ihits-procurement-upheld-shif-rollout-court-ruling-kenya\/\">Court upholds Safaricom-led health-tech contract terming procurement gaps insufficient<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-2-was-the-ihits-tender-illegal\"><strong>2. Was the IHITS tender illegal?<\/strong><\/h3>\n\n\n\n<p>No\u2014but it wasn\u2019t perfect.<\/p>\n\n\n\n<p>The Court found:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The government followed the law in using a special procurement method<\/li>\n\n\n\n<li>But there were procedural weaknesses, especially:\n<ul class=\"wp-block-list\">\n<li>Limited transparency<\/li>\n\n\n\n<li>Weak documentation<\/li>\n\n\n\n<li>Reduced competition<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>Still, the Court said these were not serious enough to cancel the contract.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-3-why-didn-t-the-court-stop-the-tender-despite-the-flaws\"><strong>3. Why didn\u2019t the Court stop the tender despite the flaws?<\/strong><\/h3>\n\n\n\n<p>Because:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>There was no proof of fraud or corruption<\/li>\n\n\n\n<li>Experts\u2014not judges\u2014handle technical evaluations<\/li>\n\n\n\n<li>The law allows special procurement in urgent or strategic projects<\/li>\n<\/ul>\n\n\n\n<p>The Court made it clear: Not every mistake equals illegality.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-4-did-the-ministry-of-health-overstep-its-powers\"><strong>4. Did the Ministry of Health overstep its powers?<\/strong><\/h3>\n\n\n\n<p>No.<\/p>\n\n\n\n<p>Although the Digital Health Agency (DHA) is legally mandated to run the system:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It was not operational at the time<\/li>\n\n\n\n<li>It lacked funding, staff, and systems<\/li>\n<\/ul>\n\n\n\n<p>So the Ministry stepped in.<\/p>\n\n\n\n<p>The Court said blocking the Ministry would have created an \u201cabsurd and unworkable\u201d situation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-5-is-shif-legal\"><strong>5. Is SHIF legal?<\/strong><\/h3>\n\n\n\n<p>Yes\u2014fully.<\/p>\n\n\n\n<p>The Court upheld:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>All key SHIF regulations<\/li>\n\n\n\n<li>The law creating the fund<\/li>\n\n\n\n<li>The structure of the three health funds<\/li>\n<\/ul>\n\n\n\n<p>It also ruled that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Parliament did not annul the regulations (despite claims)<\/li>\n<\/ul>\n\n\n\n<p>Bottom line: SHIF is legally valid<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-6-so-what-went-wrong\"><strong>6.
