{"id":797119,"date":"2026-03-21T10:18:08","date_gmt":"2026-03-21T07:18:08","guid":{"rendered":"https:\/\/www.capitalfm.co.ke\/news\/?p=797119"},"modified":"2026-03-21T10:18:08","modified_gmt":"2026-03-21T07:18:08","slug":"ahmednassir-questions-kenya-icc-icj-dual-judicial-bids-strategy","status":"publish","type":"post","link":"https:\/\/www.capitalfm.co.ke\/news\/2026\/03\/ahmednassir-questions-kenya-icc-icj-dual-judicial-bids-strategy\/","title":{"rendered":"Ahmednassir warns Kenya\u2019s dual ICC, ICJ bids &#8216;strategic misstep&#8217;"},"content":{"rendered":"\n<p><strong>NAIROBI, Kenya, Mar 21 \u2014 Lawyer Ahmednassir Abdullahi has questioned the government\u2019s strategy of fielding candidates for judicial positions at both the International Criminal Court and the International Court of Justice within the same electoral cycle.<\/strong><\/p>\n\n\n\n<p>In a statement, Abdullahi warned that the move could undermine Kenya\u2019s chances of securing representation at either court.<\/p>\n\n\n\n<p>He argued that nominating candidates with overlapping election timelines risks weakening the country\u2019s diplomatic leverage.<\/p>\n\n\n\n<p>\u201cSo what is the Government of Kenya smoking?\u201d Abdullahi posed, questioning the rationale behind launching two campaigns simultaneously.<\/p>\n\n\n\n<p>\u201cKenya knows it doesn\u2019t have the leverage or political gravitas on the international plane to have two judges in the ICJ and ICC,\u201d he added.<\/p>\n\n\n\n<p>Kenya has formally launched the candidature of Phoebe Okowa for a full nine-year term at the ICJ covering 2027\u20132036, even as it nominated Njoki Ndung\u2019u for election as a judge of the ICC in December 2026.<\/p>\n\n\n\n<p>Abdullahi said the overlapping timelines could complicate Kenya\u2019s diplomatic push, warning that if Ndung\u2019u secures the ICC seat in 2026, Okowa\u2019s bid for a full ICJ term the following year could face resistance from countries seeking broader regional representation.<\/p>\n\n\n\n<p>\u201cMany countries will rightly argue during the December elections for the ICC that Kenya already has Prof. Okowa at the ICJ and electing Justice Njoki to the ICC isn\u2019t fair to regional or international representation,\u201d he said.<\/p>\n\n\n\n<p>Okowa was elected to the ICJ in November 2025 to fill a casual vacancy created by the resignation of Somali judge Abdulqawi Ahmed Yusuf. Her current term runs until February 2027, and she became only the eighth woman in history to sit on the world court.<\/p>\n\n\n\n<p>Foreign Affairs Principal Secretary Korir Sing\u2019Oei earlier defended her candidacy, describing her as a trailblazer whose scholarship and practical expertise have shaped global jurisprudence.<\/p>\n\n\n\n<p>\u201cAs the first African woman on the International Law Commission and now a judge of the world court, Judge Okowa is a trailblazer,\u201d Sing\u2019Oei said during the launch of her re-election campaign.<\/p>\n\n\n\n<p>Meanwhile, President William Ruto nominated Ndung\u2019u\u2014who has served as a Supreme Court judge since 2011\u2014as Kenya\u2019s candidate for the ICC judicial elections scheduled for December 2026.<\/p>\n\n\n\n<p>The elections, to be held during the Assembly of States Parties session from December 7 to 17, will fill six judicial seats at the Hague-based court.<\/p>\n\n\n\n<p>Ndung\u2019u is expected to face competition from candidates nominated by several countries, including Tanzania, Uganda, Ghana, Switzerland, Colombia and Japan.<\/p>\n\n\n\n<p>Abdullahi termed the dual candidacies a \u201cstrategic misstep,\u201d warning that running two high-profile campaigns in the same cycle risks setting one up for failure.<\/p>\n\n\n\n<p>\u201cOf the two good ladies, who is being set up for failure and
