{"id":733816,"date":"2023-10-17T12:45:09","date_gmt":"2023-10-17T09:45:09","guid":{"rendered":"https:\/\/www.capitalfm.co.ke\/news\/?p=733816"},"modified":"2023-10-17T12:45:23","modified_gmt":"2023-10-17T09:45:23","slug":"court-rules-josephine-kabura-4-others-have-case-to-answer-in-sh791mn-nys-corruption-case","status":"publish","type":"post","link":"https:\/\/www.capitalfm.co.ke\/news\/2023\/10\/court-rules-josephine-kabura-4-others-have-case-to-answer-in-sh791mn-nys-corruption-case\/","title":{"rendered":"Court rules Josephine Kabura, 4 others have case to answer in Sh791mn NYS corruption case"},"content":{"rendered":"\n<p><strong>NAIROBI, Kenya, Oct 17 &#8211; A Nairobi Court has ruled that businesswoman Josephine Kabura and four others have a case to answer in the Sh791 million National Youth Service (NYS) corruption case. <\/strong><\/p>\n\n\n\n<p>Trial magistrate Wendy Micheni on Monday ruled that they will now have to defend themselves in the case facing them.<\/p>\n\n\n\n<p>She however set free former NYS Director General Nelson Githinji, former Principal Secretary Peter Mangiti, businessman Ben Gethi and\u00a0others in the graft case.<\/p>\n\n\n\n<p>Micheni ruled that the prosecution failed to produce enough evidence linking them to the theft.<\/p>\n\n\n\n<p>The magistrate further noted that the prosecution relied on general information which was not backed up by both electronic and documentary evidence.<\/p>\n\n\n\n<p>&#8220;Having failed to establish a prima facie case against the accused persons, i hereby acquit them for lack of evidence ,&#8221;the magistrate ruled.<\/p>\n\n\n\n<p>In the case the Prosecution called more than 50 witnesses to testify against Magiti and others.<\/p>\n\n\n\n<p>In 2015, the accused persons denied the charges of conspiracy and theft of the money.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>NAIROBI, Kenya, Oct 17 &#8211; A Nairobi Court has ruled that businesswoman Josephine Kabura and four others have a case to answer in the Sh791 million National Youth Service (NYS) corruption case.
