{"id":703799,"date":"2022-10-25T17:18:42","date_gmt":"2022-10-25T14:18:42","guid":{"rendered":"https:\/\/www.capitalfm.co.ke\/news\/?p=703799"},"modified":"2022-10-25T17:18:48","modified_gmt":"2022-10-25T14:18:48","slug":"why-azimio-mps-rejected-linturi-as-agriculture-cabinet-secretary-nominee-in-dissenting-report","status":"publish","type":"post","link":"https:\/\/www.capitalfm.co.ke\/news\/2022\/10\/why-azimio-mps-rejected-linturi-as-agriculture-cabinet-secretary-nominee-in-dissenting-report\/","title":{"rendered":"Why Azimio MPs rejected Linturi as Agriculture Cabinet Secretary nominee in dissenting report"},"content":{"rendered":"\n<p><strong>NAIROBI, Kenya, Oct 25 &#8211; The Cabinet Secretary nominee for Agriculture and Livestock, Mithika Linturi has been rejected due to the pending cases which have raised integrity questions on his eligibility.<\/strong><\/p>\n\n\n\n<p>In the dissenting report largely by Azimio La Umoja One Kenya MPs, Linturi was disapproved because of 35 pending civil cases and one criminal case of attempted rape.<\/p>\n\n\n\n<p>Even with pending cases, the minority report cited that Linturi did not authoritatively pronounce himself on the issues against him.<\/p>\n\n\n\n<p>\u201cThe members found that Hon Mithika Linturi is unfit to hold public office due to the gravity of criminal case against her, the integrity questions it raises, and the unsatisfactory responses provided. The members therefore reject his nominations to the cabinet,\u201d the report read.<\/p>\n\n\n\n<p>Aside from that, they raised questions on questionable academic qualifications requirements including his Indian University degree which could not be traced.<\/p>\n\n\n\n<p>Further, they poked holes on the explanation given by the Agriculture nominee on the legitimacy of his undergraduate degree where he explained that the academic qualification in question was the masters law degree from the institution.<\/p>\n\n\n\n<p>\u201cI don\u2019t have any dispute with the University of Law degree what is in contention is master degree programme,\u201d Linturi in his response before the committee stated.<\/p>\n\n\n\n<p>The minority report also rejected the nomination of Aisha Jumwa, the nominee for Public Service and Gender due to her ongoing murder case where she was accused of murdering Juma Ngumbao.<\/p>\n\n\n\n<p>The report disapproving Jumwa appointment argues that although the constitution hold that one is innocent until proven guilty, the requirement doesn\u2019t hold for individuals appointed in high public office.<\/p>\n\n\n\n<p>\u201cThe members stated that they hold the strong view that the principle of presumption of innocence until proven guilty should never apply in situations of appointment to a high public office in the Republic of Kenya,\u201d read the report.<\/p>\n\n\n\n<p>A section of Azimio La Umoja One Kenya who were in support of the minority report insisted that although Jumwa argued that she shot no one and even offered to be a prosecution witness in the murder case, her revelations were basically unconvincing.<\/p>\n\n\n\n<p>\u201cThe members found that Hon Aisha Jumwa is unfit to hold public office due to the gravity of criminal case against her, the integrity questions it raises, and the unsatisfactory responses provided. The members therefore rejects her nominations to the cabinet,\u201d the report read.<\/p>\n\n\n\n<p>Before the National Assembly appointment committee where she was being vetted for the cabinet slot, Jumwa was forced to come clean on the matter after she was implicated in the murder of Michael Ngumbao during a mini poll in Ganda Ward.<\/p>\n\n\n\n<p>\u201cI am clear in my mind that I never shot anyone because I don\u2019t own a gun.I am not a gun holder and I don\u2019t know the names of the guns in this country,\u201d Jumwa said.<\/p>\n\n\n\n<p>Jumwa was charged alongside her bodyguard Geoffrey Okuto in 2020 over Ngumbao\u2019s murder.<\/p>\n\n\n\n<p>\u201cThere are three witnesses who testified and none mentioned my name.The ballistic done also didn\u2019t link me,so am I innocent until proven guilty,\u201d she said.<\/p>\n\n\n\n<p>This comes hours after Ngumbao applied to drop the murder case against the vocal politician.<\/p>\n\n\n\n<p>The decision to withdraw charges against the former Malindi MP was communicated to a Mombasa court on Tuesday.<\/p>\n\n\n\n<p>\u201cThe victim\u2019s family was desirous of having the matter settled out of court considering that the second accused was not the principle offender in this matter,\u201d Senior State Counsel Vivian Kambaga told the High Court.<\/p>\n\n\n\n<p>\u201cThe ODPP has received this prayers and it\u2019s being considered at the moment, and we will be able to come back to you with an informed decision and next course of action,\u201d she added.<\/p>\n\n\n\n<p>In a report tabled by Majority Leader Kimani Ichungwa, the majority report of the committee chaired by Speaker Moses Wetangula approved all nominees apart from Peninnah Malonza, the nominee for Tourism and Wildlife.<\/p>\n\n\n\n<p>The announcement led to jeering and booing by a section of members from the house with the Speaker Wetangula bringing the house to order.<\/p>\n\n\n\n<p>\u201cOrder, order Honorable Members that is just a notice of motion, each one of you will have time to debate, ventilate and vote on this motion and you have a right to vote the way you want,\u201d said Speaker Wetangula.<\/p>\n\n\n\n<p>Lawmakers are slated to vote on the report tomorrow afternoon after a rigorous debate today and tomorrow morning.<\/p>\n\n\n\n<p>\u201cAny strong views you have for either of the nominee, I urge you to observe parliamentary decorum and dignity and debate the motion and you will vote on it at the end of debate tomorrow,\u201d the speaker of the house.<\/p>\n\n\n\n<p>\u201cThe power of your vote that matters more than the manner you address yourselves with rigorous voices,\u201d he added.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>NAIROBI, Kenya, Oct 25 &#8211; The Cabinet Secretary nominee for Agriculture and Livestock, Mithika Linturi has been rejected due to the pending cases which have raised integrity questions on his eligibility.
