{"id":65235,"date":"2013-11-21T08:57:30","date_gmt":"2013-11-21T08:57:30","guid":{"rendered":"https:\/\/www.capitalfm.co.ke\/news\/?p=65235"},"modified":"2013-11-21T12:06:18","modified_gmt":"2013-11-21T12:06:18","slug":"appeal-court-reinstates-timamy-as-lamu-governor","status":"publish","type":"post","link":"https:\/\/www.capitalfm.co.ke\/news\/2013\/11\/appeal-court-reinstates-timamy-as-lamu-governor\/","title":{"rendered":"Appeal court reinstates Timamy as Lamu Governor"},"content":{"rendered":"<div id=\"attachment_65236\" style=\"width: 640px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/www.capitalfm.co.ke\/news\/files\/2013\/11\/BALLOT-BOXES.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-65236\" class=\"size-full wp-image-65236\" alt=\"Ballot boxes used in the last general election\/FILE\" src=\"https:\/\/www.capitalfm.co.ke\/news\/files\/2013\/11\/BALLOT-BOXES.jpg\" width=\"630\" height=\"350\" srcset=\"https:\/\/www.capitalfm.co.ke\/news\/files\/2013\/11\/BALLOT-BOXES.jpg 630w, https:\/\/www.capitalfm.co.ke\/news\/files\/2013\/11\/BALLOT-BOXES-300x167.jpg 300w\" sizes=\"auto, (max-width: 630px) 100vw, 630px\" \/><\/a><p id=\"caption-attachment-65236\" class=\"wp-caption-text\">Ballot boxes used in the last general election\/FILE<\/p><\/div>\n<p><strong><strong>MALINDI, Kenya, Nov 21 \u2013 Issa Timamy has regained his Lamu Governor\u2019s seat after Court of Appeal sitting in Malindi overturned the nullification of his March 4 election.<\/strong><\/strong><\/p>\n<p>A three-judge bench comprising of Appellate judges Hannah Okwengu, Asike Makhandia and Fatuma Sichale ruled that Timamy was validly elected as governor of Lamu County.<br \/>\nThe Court of Appeal disagreed with a September 27 ruling by High Court judge Florence Mucheni who revoked Timamy\u2019s win saying the election was marred with a lot of irregularities and directed a fresh election.<\/p>\n<p>In their ruling, the Appellate judges noted the grounds for nullification given by the High Court in its verdict could not hold.<\/p>\n<p>The ruling by the Court of Appeals means a by-election slated for December 2 will not take place.<\/p>\n<p>Campaigns for the seat were already underway where Timamy who is running on a UDF ticket was to face off with The National Alliance\u2019s (TNA) Fahim Twaha.<\/p>\n<p>Timamy has welcomed the court verdict and has appealed to Twaha to join him in developing Lamu County.<\/p>\n<p>The judge made the ruling in a petition filed by the poll loser Twaha who had requested the election be nullified because it was marred by chaos and rigging.<\/p>\n<p>Twaha had challenged Timamy\u2019s win saying the Independent Electoral and Boundaries Commission (IEBC) did not announce the number of votes the winner had garnered.<\/p>\n<p>He testified how the Deputy Presiding Officer was found in a cyber caf\u00e9 within Lamu town altering form 35 in favour of Timamy.<br \/>\nThe Deputy Presiding Officer has since been convicted and sentenced to serve three years in prison.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>MALINDI, Kenya, Nov 21 \u2013 Issa Timamy has regained his Lamu Governor\u2019s seat after Court of Appeal sitting in Malindi overturned the nullification of his March 4 election.
