{"id":60451,"date":"2013-09-11T06:18:08","date_gmt":"2013-09-11T06:18:08","guid":{"rendered":"https:\/\/www.capitalfm.co.ke\/news\/?p=60451"},"modified":"2013-09-11T06:18:08","modified_gmt":"2013-09-11T06:18:08","slug":"cord-walks-out-again-as-senate-okays-icc-pullout","status":"publish","type":"post","link":"https:\/\/www.capitalfm.co.ke\/news\/2013\/09\/cord-walks-out-again-as-senate-okays-icc-pullout\/","title":{"rendered":"CORD walks out again as Senate okays ICC pullout"},"content":{"rendered":"<p><div id=\"attachment_60454\" style=\"width: 418px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/www.capitalfm.co.ke\/news\/files\/2013\/09\/ICC-HEADQUARTERS1.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-60454\" src=\"https:\/\/www.capitalfm.co.ke\/news\/files\/2013\/09\/ICC-HEADQUARTERS1.jpg\" alt=\"ICC cases against Deputy President William Ruto and Joshua Sang kicked off on Tuesday\/FILE\" width=\"408\" height=\"245\" class=\"size-full wp-image-60454\" srcset=\"https:\/\/www.capitalfm.co.ke\/news\/files\/2013\/09\/ICC-HEADQUARTERS1.jpg 408w, https:\/\/www.capitalfm.co.ke\/news\/files\/2013\/09\/ICC-HEADQUARTERS1-300x180.jpg 300w\" sizes=\"auto, (max-width: 408px) 100vw, 408px\" \/><\/a><p id=\"caption-attachment-60454\" class=\"wp-caption-text\">ICC cases against Deputy President William Ruto and Joshua Sang kicked off on Tuesday\/FILE<\/p><\/div><strong>NAIROBI, Kenya, Sep 11 &#8211; CORD Senators staged a walkout on Tuesday as the Senate approved a Motion to petition the International Criminal Court to conduct Kenyan cases via video link, shorten the calendar, and refer cases to a local tribunal.<\/p>\n<p>During the debate which was dominated by sideshows, CORD lost an attempt to amend the Motion so Kenya does not withdraw from the Rome Statute that establishes the ICC.<\/strong><\/p>\n<p>The amendment which was moved by Migori Senator Wilfred Machage and seconded by Mombasa Senator Hassan Omar Hassan also provided a light moment in the House after the Senate Speaker initially ruled that the amendment had been approved but changed his decision after Jubilee legislators protested.<\/p>\n<p>CORD questioned the timing of the Motion which they argued is sending a wrong message to The Hague-based court which began hearing crimes against humanity cases levelled against Deputy President William Ruto and journalist Joshua arap Sang on Tuesday.<\/p>\n<p>It took Senate Majority Leader Kithure Kindiki one hour and thirty minutes to move the Motion as Senators James Orengo, Boni Khalwale and Machage requested Speaker Ekwe Ethuro to rule whether the Motion was rightly before the House.<\/p>\n<p>Khalwale wondered if the Motion was sub-judice coming at a time when the ICC cases are in progress. He argued Kenya being a member of the Rome Statute, should wait until the cases are concluded.<\/p>\n<p>The Kakamega Senator argued that the Motion should have had Cabinet approval and it should have been accompanied with a report from the President why it is in the national interest to exit the Rome Statute.<\/p>\n<p>Speaker Ethuro ruled this out of order saying that he cannot interfere with matters of the Cabinet. He declared the House had the authority to discuss any matter so long as it is does not interfere with its proceedings.<\/p>\n<p>There was another 10 minute disruption to Kindiki&#8217;s contribution after Elgeyo-Marakwet Senator Kipchumba Murkomen rose and named Africog Executive Director Gladwell Otieno as the civil society leader who wrote to the ICC judges advising them against referral of the cases back to Kenya.<\/p>\n<p>Siaya Senator James Orengo was next in line, as he demanded the Speaker to explain why he considered the Motion to be &#8220;urgent and necessary&#8221; which is a parameter in the Standing Orders for the House to be recalled.<\/p>\n<p>Meru Senator Kiraitu Murugi came to the Speaker\u2019s defence and declared that the Standing Orders do not allow a Senator to ask the Speaker for an explanation why he convened the special sitting.<\/p>\n<p>CORD Senators Otieno Kajwang and Orengo said it was against House debating regulations for a member to mention the names of people who cannot defend themselves on the floor of the House.<\/p>\n<p>The Speaker was forced to reduce the time for contribution to 10 minutes from the usual 30 minutes after he expressed concern that members would not have sufficient time to deliberate the issue.<\/p>\n<p>Kindiki&#8217;s argument was that the ICC cannot ignore the Senate resolution when it was swayed by the voice of a civil society leader.<\/p>\n<p>&#8220;NGOs converted our country&#8217;s misery into a money-minting strategy,&#8221; says Kindiki. &#8220;They cook up stories and bring up fiction we see at ICC.&#8221;<br \/>\n<!--nextpage--><br \/>\nMinority Leader Moses Wetangula led the opposition leaders in opposing the Motion which he termed &#8216;incompetent and ill-timed,&#8217; because it came when both the President and his Deputy had committed to honouring the summons from the war crimes court.<\/p>\n<p>CORD Senators argued that the Rome Statute is a deterrent and was the reason there was no chaos in Kenya despite the fact the results of the General Election in March were contested.<\/p>\n<p>\u201cCourage is not courage if you use courage to knock your head against the wall. It is called stupidity,&#8221; said Wetangula.<\/p>\n<p>The Bungoma Senator narrated how the Grand Coalition Government made every effort to ensure the cases are not taken to The Hague but it failed. He said the Cabinet then under the leadership of President Kibaki and Prime Minister Raila Odinga resolved to that no Kenyan should be tried in a foreign court.<\/p>\n<p>&#8220;We stand here shamed and carrying a collective shame as a country because our compatriots are on trial in a foreign country,&#8221; Wetangula declared as he concluded his contribution.<\/p>\n<p>Senator Orengo and Busia Senator Amos Wako also questioned the wisdom behind the Motion. Orengo advised the Majority Leader to consider amending the Rome Statute by lobbying the Assembly of States Parties, (which African states have a majority).<\/p>\n<p>Article 123 of the Rome Statute of the International Criminal Court provided for a Review Conference on the workings of the Statute, to be convened seven years after the Statute\u2019s entry into force.<\/p>\n<p>Wako repeated an assertion he made as Attorney General that the threshold for evidence has not been met in the ICC cases for a conviction.<\/p>\n<p>He advised against the pullout bid, saying it would put Kenyan leaders at the mercy of any judicial process.<\/p>\n<p>&#8220;In international law we have something called the jurisdiction of national courts, where we have seen local courts in France issuing warrants against Rwandan President Kagame&#8217;s aide.  The question here is would you rather have your leaders prosecuted in Magistrate Courts or international cases that have been tried and tested,&#8221; posed Wako.<\/p>\n<p>&#8220;People at The Hague will be guided by points of law and the weight of the evidence, not the ethnicity of the suspects,&#8221; Kakamega Senator Boni Khalwale said in his contribution.<\/p>\n<p>Nominated Senator Elizabeth Ongoro recalled the anguish she went through while trying to clear her name after she was listed in Kenya National Commission on Human Rights report as among the leaders who had financed the 2007\/8 post election violence.<\/p>\n<p>She however said the Kenyan cases were better off at The Hague because if the Kenyan leaders were found innocent, they would be vindicated both internationally and local through a credible judicial process.<\/p>\n<p>&#8220;This is good for them, because no one will say you have been set free because, the judge came from your community or region or party,&#8221; said Ongoro. <\/p>\n<p>Kiraitu, a former Justice Minister reiterated the Jubilee Coalition stand that the ICC was a form of neo-colonialism.<\/p>\n<p>\u201cPeople talk about agreements but forget that colonialism was introduced in Africa through agreements.
