His jacket was torn during arrest\/MIKE KARIUKI<\/p><\/div>NAIROBI, Kenya, Apr 5 &#8211; Embakasi MP Ferdinard Waititu who was arrested on Thursday morning appeared in court hours later &#8211; but for a charge dating back two years ago.<\/p>\n<p>The MP was accused of inciting his constituents to oppose evictions from KPA slum in Embakasi in December 2010.<\/p>\n<p>Waititu who was charged alongside Patrick Mulili denied the charge and was released on a cash bail of Sh100,000.<\/p>\n<p>The MP was accompanied by his colleagues Mike Sonko Mbuvi of Makadara and Yusuf Ahmed of Kamukunji to the Milimani Commercial Court where the charges were read to him.<\/p>\n<p>The charge sheet read: \u201cOn December 13, 2010 at KPA slums in Embakasi, without lawful excuse uttered words namely; \u2018protest the eviction and throw stones to police\u2019 an act which was calculated to lead to the disobedience of the law and obstruction of police officers in the performance of their duty.\u201d<\/p>\n<p>Mulili was however absent since police have not managed to effect a warrant for his arrest.<\/p>\n<p>Nairobi Chief Magistrate Esther Maina directed Waititu\u2019s trial to begin on May 3.<\/p>\n<p>The Water Assistant Minister was arrested on Thursday morning, after he tried to stop yet another demolition of houses built on a road reserve in his Embakasi constituency.<\/p>\n<p><object width=\"408\" height=\"306\"><param name=\"movie\" value=\"http:\/\/www.youtube.com\/v\/F16k7WCUVV4?version=3&amp;hl=en_US\"><\/param><param name=\"allowFullScreen\" value=\"true\"><\/param><param name=\"allowscriptaccess\" value=\"always\"><\/param><embed src=\"http:\/\/www.youtube.com\/v\/F16k7WCUVV4?version=3&amp;hl=en_US\" type=\"application\/x-shockwave-flash\" width=\"408\" height=\"306\" allowscriptaccess=\"always\" allowfullscreen=\"true\"><\/embed><\/object><\/p>\n<p>Witnesses said the MP accompanied by a group of youths stormed the demolition site near Benrose in Umoja estate demanding that the exercise be stopped.<\/p>\n<p>Nairobi Police boss Antony Kibuchi said the group started throwing stones at the police when they were ordered to leave the site injuring some officers.<\/p>\n<p>He said Waititu would be arraigned in court to face further incitement charges.<\/p>\n<p>The demolition is aimed at paving way for the expansion of the road.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>NAIROBI, Kenya, Apr 5 &#8211; Embakasi MP Ferdinard Waititu who was arrested on Thursday morning appeared in court hours later &#8211; but for a charge dating back two years ago.
