NAIROBI, Kenya Feb 3 – The Employment and Labour Relations Court has temporarily suspended the reappointment of Joe Sang as the Acting Managing Director of Kenya Pipeline Company (KPC).
The court issued the orders Friday in the case which was filed by the Law Society of Kenya (LSK).
On January 23, 2023, KPC reappointed Sang after clearing him of a corruption-related case regarding the construction of the Kisumu Oil jetty valued at Sh1.9 billion.
The board subsequently, appointed Sang to replace Samson Macharia Irungu whose three-year term ended in January 2023.
“This court issues a conservatory order staying the appointment of the 1st interested party as the Acting Managing Director of the Kenya Pipeline Company pending the hearing and determination of this petition,” the court ruled.
The court in the meantime ruled that KPC is at liberty to appoint any employee holding a senior management position as the Acting Managing Director.
Attorney General Justin Muturi had sanctioned the reappointment of Sang back at the agency.
” “It is our advice that there is nothing in the law and in KPC’s constitutive and governance instruments that bars the appointment of an acting Managing Director from outside KPC and or the parent Ministry as long as there is compliance,” he said.
The case is due for mention on March 10, 2023.
