Prosecution seeks life imprisonment for Baringo chief who defiled a girl, procured an abortion

Counsel Joseck Abwajo who gave his submission on Thursday asked the court to impose stiff penalty on Thomas Chesang, who is accused of intentionally and unlawfully defiling a minor on diverse dates between February and August 2021 in Kasaka village, Baringo North sub-county.

NAIROBI, Kenya, Jan 14 — The prosecution at a Kabarnet Court wants life imprisonment imposed on an Assistant Chief from Baringo county, charged with defiling and impregnating a standard seven girl.

Counsel Joseck Abwajo who gave his submission on Thursday asked the court to impose stiff penalty on Thomas Chesang, who is accused of intentionally and unlawfully defiling a minor on diverse dates between February and August 2021 in Kasaka village, Baringo North sub-county.

Chesang appeared before Kabarnet Senior Resident Magistrate Caroline Ateya for the ruling of the case he had denied. He was charged with a second count of committing an indecent act with a child contrary to Section 11(1) of the Sexual Act No. 3 of 2006.

Abwajo told the court that the accused, apart from committing an inhuman act to a vulnerable and innocent person, he asserted authority to have the victim taken for illegal abortion in an attempt to conceal evidence.

The prosecutor noted that the victim no longer stays at their ancestral home and has been forced to leave their home for fear, after the foetus was ripped out of her womb.

“Your honour if that is not too much for a 14-year-old, then I don’t know what to certify as too much,” he said.

He noted that life imprisonment will not be speaking only to the court, but to the public at large in a society which is currently experiencing rise in such offences.

However, the advocate of the accused prayed to the court for a non-custodial sentence to the accused, whom he stated has many responsibilities for he was a father of eight and still taking care of his 87-year old mother.

“We pray that the court exercises its innermost decision in sentencing the accused because of the fact that the accused has been in custody for over a year,” the advocate added.

Ateya will give final verdict after the defense counsel concludes giving their final submissions in the case.
