NAIROBI, Kenya, May 7 – The High Court has dismissed an application seeking to block Professor Tom Ojienda as the Law Society of Kenya nominee to the Judicial Service Commission.
Justice James Makau said the court lacks jurisdiction to entertain the petition, for which the applicant Mark Ndungu ought to have sought arbitration.
The judge ruled that the LSK has a dispute resolution mechanism which should have been approached first as the law requires before moving the court.
“The petitioner should have exhausted the internal dispute mechanism before filing this petition,” the judge said in his judgement.
The LSK members are to elect their representative to JSC on May 9, 2019.
