NAIROBI, Kenya, Apr 5 – The Clerk of the National Assembly Michael Sialai has declined to act against the expulsion of Nominated Member of Parliament Godfrey Osotsi after his party, Amani National Congress sought to have him axed from his position.
In a letter sent to newsrooms, Sialai said he could not okay the expulsion until articles 103 and 105 of the Constitution that stipulate clear guidelines on how an MP’s seat is declared vacant are followed.
Osotsi’s woes began when ANC Secretary General Barrack Muluka accused the lawmaker of not toeing the party line, consequently, kick-starting his removal process from the party with a letter sent to both the Registrar of Political Parties and the Clerk of the National Assembly.
“Godfrey Osotsi stands expelled from ANC. He is no longer a member of this party and ceases to enjoy the privileges attendant of being a member of the party, or to act on behalf of the party in anyway whatsoever,” read the notification letter
“Kindly accept this letter to serve as a formal request by ANC party, beseeching you to commence the requisite statutory procedures and attendant actions with respect to the said Godfrey Osotsi, as befits a nominated MP whose membership of the sponsoring party has been terminated.”
In a letter dated January 10, 2019, the party disciplinary committee secretary Dan Ameyo wrote to Osotsi informing him of complaints of financial impropriety allegedly identified by the Auditor General, further notifying him of commencement of disciplinary proceedings.
The allegations against the one-time ANC Secretary General were that he did not prepare a budget and financial statements.
He was also accused of failure to account for Sh50 million as well as suspicions of failing to remit all revenue received by the party.
Ameyo further said Osotsi failed to honour party invitations to explain various queries.
On Tuesday however, Osotsi, filed a case before the Constitutional Division Court challenging his expulsion from the Amani National Congress.
The legislator accused the Musalia Mudavadi-led party of “consistently, and maliciously withholding important information that would enable him respond to the charges levelled against him and facilitate his application for an appeal or review.”
