NAIROBI, Kenya, Dec 5 – Director of Public Prosecutions (DPP) Noordin Haji has now appointed the Queen’s Counsel Khawar Qureshi to handle the graft case facing Deputy Chief Justice Philomena Mwilu.
Haji stated that he took the step because most senior lawyers in the country and those in his office were uncomfortable.
He said that he opted for an independent person who is not shrouded by the local political and professional influence.
He further pointed out that his office was forced to source for an independent person after Dorcas Odour who was in charge was accused of being impartial.
A five-judge bench will from Thursday begin hearing Mwilu’s petition contesting her prosecution over graft claims.
The five-judge bench comprises of Hellen Omondi, Mumbai Ngugi, William Musyoka, Francis Tuiyot and Chacha Mwita allowed parties to agree on issues for determination and file them in court within a week.
Should the Attorney General, Director of Public Prosecutions and the DCJ fail to concur on the issues, the court has said it will instead pick them.
