Judge in Gakuo’s appeal regrets his death before justice was done

NAIROBI, Kenya, Oct 31 – The judge who was presiding over the appeal by former Nairobi Town Clerk John Gakuo says he regrets his death as it occurred before justice could be done.

Justice John Onyiego stated that he was keen to hear the appeal expeditiously having denied Gakuo, former PS Sammy Kirui and former Nairobi County Legal Secretary Mary Ng’ethe bail pending appeal.

He however indicated that the appeal will still proceed without Gakuo and is set for the 8th of next month.

“I was keen to have this matter heard expeditiously but it is unfortunate about the circumstances that have occurred before the court could resolve it,” he said.

The appeal had been adjourned last week and was set to be heard today since the judge was presiding over another case in Kisumu.

Gakuo and his co-accused had been given a week to file evidence crucial to clear their names over the Sh283 Cemetery scandal.

Kirui and Ng’ethe are fighting a three-year jail term following their conviction in May by an anti-corruption court.

Gakuo’s lawyer Assa Nyakundi will also be filing hospital records confirming his demise.

Until his conviction, Gakuo was touted as the possible replacement of Polycarp Igathe who resigned as Deputy Governor in Nairobi County.

He was credited for a transformational record in Nairobi during his tenure as the city town clerk, even though dogged with corruption scandals that sent him to prison.
