Setback for Ranguma as he loses bid for vote scrutiny

KISUMU, Kenya, Nov 16 – Former Kisumu Governor Jack Ranguma has lost an application seeking scrutiny and a vote recount in an election petition he filed against incumbent Governor Anyang’ Nyong’o.

Kisumu High Court Judge David Majanja termed the application seeking the scrutiny and vote recount as broad and vague.

Majanja says the petitioner through the affidavits and witnesses failed to convince the court that it was necessary to carry out scrutiny of the votes cast in the gubernatorial contest.

Reading out the ruling Thursday morning, Majanja said no affidavit sworn was specific of any polling station that required further examination on the votes cast.

He ruled the application lacked clarity pointing out that he would have granted the petitioner the prayers if they laid clear basis for such scrutiny in specific polling stations within a constituency.

Majanja however said he might change his mind after listening to the two respondents in regard to vote recount and scrutiny but insisted that it is too early to give such orders.

IEBC as the first respondent in the case and Governor Nyong’o the second respondent will be cross examined by the lawyers representing the petitioner from next week.
