DPP directs release of Gakuru’s driver, to give directions on matter

The Office of the Director of Public Prosecutions Keriako Tobiko made clear it had not approved the prosecution of the driver/FILE

NAIROBI, Kenya, Nov 16 – The Director of Public Prosecutions (DPP) has directed that the driver of the vehicle that killed the late Nyeri Governor Wahome Gakuru be released by police immediately.

In a statement, the DPP stated that due to the gravity of the matter, no charges should be proffered against Samuel Kinyanjui until a duplicate file from the police has been forwarded for perusal and directions.

“As indicated earlier, the attention of the DPP has been drawn to reports circulating in electronic and social media to the effect that the driver of the late Hon Wahome Gakuru has been taken into police custody and is intended to be arraigned before court today on charges of causing death by dangerous driving.”

“Accordingly, you are hereby directed to call for the relevant police file and forward the same to the DPP for perusal and appropriate directions.”

The directive came after Kinyanjui was arrested Wednesday evening and spent the night at Makuyu Police cells in Maragua Constituency Murang’a County.

He was however not arraigned at the Kigumo Law courts to answer charges of careless driving since the police didn’t have the green light from the DPP.

The court could not approve the charge sheet since it didn’t contain an authorization from Director of Public Prosecution and it had to go back to follow the legal procedure.

The date for taking of plea will communicated later after the DPP have perused through the file.

Gakuru will be laid to rest this Saturday following his tragic death at Makenji area in Murang’a County.
