NAIROBI, Kenya, Sep 13 – A petition has been filed in the High Court seeking the removal of all eight Commissioners at the Independent Electoral and Boundaries Commission (IEBC).
The petition filed by Brian Azin, Ben Wanasakaali and Kelvin Alwanga seeks to bar IEBC Chairperson Wafula Chebukati and CEO Ezra Chiloba halted from conducting the fresh presidential election scheduled for October 17.
The petitioners through lawyers, Michael Amalemba and Conrad Maloba, told the court that the IEBC Commissioners and the CEO cannot be trusted with the fresh presidential poll having bungled the August 8 General Election.
“They have been found guilty by the court… with the indictment, they have fallen short of provisions of Chapter 6 of the Constitution and Section 4 of the 4th Schedule of IEBC Election Act,” Amalemba said arguing public confidence in the electoral officials had been eroded.
The petition has been certified urgent by the court and the matter will be heard on September 22.
Duty Judge Roselyn Aburili, told the parties in the suit who include the IEBC Commissioners, the Jubilee Party and Attorney General to file their respective responses within 14 days and prepare for the hearing.
The Supreme Court on September 1 annulled the presidential election held last month and ordering a repeat within 60 days.
The ruling effectively rendered null and void the declaration of President Uhuru Kenyatta and his deputy William Ruto as winners of the poll.
