Rarieda independent candidate out of polls after failing to pay fine

, NAIROBI, Kenya, Jul 4 – An Independent candidate vying for the Rarieda Parliamentary seat Augustine Netto Adhola has been disqualified from participating in the August 8 contest after he failed to pay a Sh250,000 fine imposed on him.

The Independent Electoral and Boundaries Commission Electoral Code of Conduct Enforcement Committee ruled he had breached Electoral Code of Conduct.

In a statement, the committee which is chaired by IEBC Chairman Wafula Chebukati explained that they arrived at the decision after ‘Augustine Netto Adhola failed, neglected and ignored to obey any of the Orders or at all.’

Chebukati noted that the time-frame for compliance lapsed on June 24.

The electoral chief emphasised that Enforcement Committee is a statutory committee of the IEBC whose judgments must be obeyed without excuse.

He termed it an affront on the Rule of Law if the team was to condone disregard of it’s decision.

“The Commission will continue to strictly enforce the Electoral Code of Conduct, across the Country: and we demand adherence of all political players. We remain committed to delivering free, fair and credible elections devoid of violence or intimidation,” said a tough talking Chebukati.

The decision against Netto emanates from a ruling the Committee delivered on June 22 in relation to a complaint lodged by Erick Onyango.

In its ruling the IEBC team ordered that Netto desists from branding his campaign material with ODM colours and further desists from branding his campaign material and regalia with images of the ODM party leader and officials.

Netto Adhola was further ordered to remove all posters and campaign materials bearing ODM colours and images of the ODM party officials and pays a fine of Sh250,000 within forty eight (48) hours.
