NAIROBI, Kenya, Nov 29 – A High Court judge on Tuesday sentenced Interior Principal Secretary Karanja Kibicho, in absentia, to three months in prison.

He has thereby directed the Inspector General of Police Joseph Boinnet to immediately arrest the Principal Secretary who was in the company of President Uhuru Kenyatta on his tour of Central Kenya, at the time of sentencing.

It however remains to be seen if the IG will carry out Odunga’s orders given it is not the first time in the present matter that he has ordered Kibicho’s arrest.

He first directed the Officer in-charge of the Central Police Division to do so on October 13 and deliver him to court to explain why Sh2.6 million in compensation is yet to be paid to a victim of the infamous Nyayo House ‘torture chambers’ close to three years after the award was made, 13 years after the complainant Michael Danson Mahugu moved to court and 29 years since the torture – the court has established – was inflicted.

When the OCPD failed to execute his orders, he directed them to the IG who also failed to execute them.

Close to three years ago, Judge Odunga made the same demand of Boinnet’s predecessor David Kimaiyo in similar circumstances.

Like Kibicho, he failed to honour court summons to explain why a proven victim of police brutality had yet to receive compensation years after the award was made.

“We do not want to create a situation where the government is embarrassing the government or maybe we are not taking due consideration,” Mwinyi said and added. “There are several processes and procedures that he (Kimaiyo) also has to observe because it not like the Principal Secretary has gone into hiding,” Masoud Mwinyi, Kimaiyo’s spokesman at the time, told journalists.

Kibicho is now the wanted man.
