Kitonga makes no bones with ‘radical’ views at CJ interview

He also sought to set the record straight in justification of the work the Judicial Commission of Inquiry into the Goldenberg Affair was mandated to do; having served as its vice-chair.

Fellow Senior Counsel Tom Ojienda put to him: “One of the claims that have been made by people who complained to this Commission (JSC) is that you underperformed as a member of the Goldenberg Commission.”

And to which he responded: “It’s good this has come out. A complaint which I heard in the press and which was also brought to the Commission that we ignored a High Court order to summon retired President Moi, the late George Saitoti and others. But immediately thereafter Moi’s lawyers and the lawyers for Saitoti went to the Court of Appeal and stayed the order.

“It is also not for this reason that Justice Samuel Bosire was removed from office. He was removed for other reasons.”

The distinguished advocate was the fourth to be interviewed for Chief Justice with Justices Alnashir Visram, Mbogholi Msagha and David Maraga having gone before him.
