Kinisu quits, joining list of jinxed EACC honchos

Mwau’s tenure in office lasted for only six months after which he was suspended and later removed in 1998 through a Judicial Tribunal appointed by the then President Daniel arap Moi.

Retired Justice Aaron Ringera was appointed to replace him in March 1999.

But on December 22, 2000, the High Court in the case of Gachiengo V Republic (2000) 1 EA 52(CAK) made a ruling that the existence of KACA then undermined the powers conferred on both the Attorney General and the Commissioner of Police by the Constitution.

In addition, the High Court further held that the statutory provisions establishing the Authority were in conflict with the Constitution.

That spelt the death of KACA.

After this, the Anti-Corruption Police Unit (ACPU) was created by Executive Order in August 2001.

ACPU, which operated under the Criminal Investigations Department (CID) took over KACA’s mantle in September 2001 and performed this function until creation of the Kenya Anti-Corruption Commission (KACC).

Justice Ringera resumed office on 10th of September 2004 but in July 2009, following parliamentary pressure, he was forced to resign from office.

This paved way for appointment of Prof P.L.O. Lumumba, who assumed office in September 2010 till August 2011, “to allow a transition to the Ethics and Anti-Corruption Commission.”

EACC was established on September 5, 2011 and Commissioners through enactment of the Ethics and Anti-Corruption Commission Act (EACC), 2011.

Mumo Matemu was later appointed as the chairperson on 5th August 2013 after the Court of Appeal quashed an earlier ruling barring him from assuming office on claims of lacking integrity.

This commissions’ life was also short lived and between March and May 2015 Commissioner Jane Onsongo, Vice Chair Irene Keino and Matemu tendered their resignations as EACC Commissioners.

Matemu was accused of abuse of office and incompetence.
