Law giving President powers to appoint CJ, deputy declared unlawful

Should the JSC decision need to be corrected, the bench heard it can be done by the relevant authority.

The court was asked to find there is no provision under the Constitution allowing the President to disapprove or resent nominees forwarded by JSC.

But the Attorney-General had maintained that the President under the JSC amended Act was not bound by JSC recommendations and there is room for discretion in the appointment of the CJ and DCJ.
