NAIROBI, Kenya, Aug 10 – The rape case against Imenti Central Member of Parliament Gideon Mwiti has been suspended.

High Court judge Weldon Korir temporarily halted the criminal proceedings pending determination of an application seeking to stop the Director of Public Prosecutions from prosecuting him.

The case will remain suspended until October 12 when Mwiti’s application is due for hearing.

The case file is due to be placed before Chief Justice Willy Mutunga to appoint judges to hear issues that Mwiti is contesting.

Meanwhile, lawyer Wilfred Ndiritu urged the court to issue summons against a local media house on claims they published a story purporting there is overwhelming evidence that the legislator raped the complainant.

This is after DNA reports from Government Chemist and Nairobi Women’s Hospital show there was no sexual intercourse.

The MP has since denied sexually assaulting the 28 year-old business lady on March 21, 2015 in Westlands.
