Judges Sankale ole Kantai, Wanjiru Karanja and Festus Azangalala, sitting in Kisumu, said the appeal lacked merit.
The judges noted that the High Court was right in its judgment and dismissed the appeal and also directed the court’s registrar to work out the fee of the appeal case.
After the ruling, Aluoch who represented himself in court thanked the judges noting that he was not surprised with the ruling.
“I am not surprised by the outcome. As a lawyer, I knew this petition was frivolous; it had no ground at all,” he said. “I have been dragged through mud and I don’t like at all…but now I can concentrate on development of Kisumu West.”
Rosa Buyu who had lodged the petition appealed to the area residents to remain united and support Aluoch to ensure service delivery to the people.
She says the decision of the court will not dampen her spirit to soldier on and represent the constituency one day.
“Olago Aluoch has been confirmed as a Member of Parliament for the constituency, it’s time to give him time to work,” she stated.
“Falling now doesn’t mean we are out, we will be back in 2017.”
