Justice Aggrey Muchelule said the recount will be carried out in Gem, Bondo and Rarieda constituencies. He ordered that the exercise begin on Thursday at 9am.
The judge further ruled that there will be a recount of votes cast in two polling station namely Awelo in Alego Usonga and Nyasanda in Ugunja constituencies.
Justice Muchelule however declined to order scrutiny of votes cast in the entire Siaya County. He explained that no sufficient evidence had been laid to warrant a scrutiny of the votes.
He ruled that the recount will be carried out on daily basis under the supervision of the deputy registrar after which a report will be made and the case mentioned on July 15 this year.
Oduol through his lawyers Richard Kwach and Dismas Wakla wanted all votes cast at the polls scrutinized or recounted in view of discrepancies and alterations in forms 35.
Oduol grabbed national headlines after he refused to step down for ex-PM Raila Odinga’s brother Oburu Odinga, during chaotic ODM party nominations.
Oduol and Oburu were both barred from vying for the seat by ODM because the winner of the nominations could not be determined.
Oduol subsequently ran for the Siaya Governor’s seat on a National Alliance Party of Kenya ticket. He however lost the election to ODM’s Cornel Rasanga Amoth.
