No way out as court orders Waititu’s arrest

He had argued that the warrant of arrest was issued with disregard to due process as the MP had not refused to honour any summons to appear in court.

Earlier in the day, police filed charges before the magistrate’s court claiming that the MP had gone into hiding and their plea to have him record statements were unsuccessful.

Waititu, who is the Embakasi MP, was caught on camera saying Maasai people should be kicked out of Kayole, after guards from the ethnic community allegedly killed a youngster.

On Tuesday, newly appointed Internal Security Minister Katoo ole Metito ordered the arrest and prosecution of Waititu over ethnic incitement.

Metito asserted that the remarks risked stirring divisive ethnic passions at a time when the country is heading towards a general election.

“No crime is ever committed by ethnic groups but by individuals who should be investigated and made to face the full wrath of the law.”

Waititu and any other person who was involved must be arrested and taken to court,” he said.

“Action will be taken and you will see the action which will be taken today (Tuesday),” the minister stressed.

The Director of Public Prosecutions Keriako Tobiko had also called for Waititu’s prosecution saying his remarks were provocative.
