NAIROBI, Kenya, Jun 8 -The Tribunal appointed to investigate the conduct of suspended Deputy Chief Justice Nancy Baraza will commence hearings on July 2.

A statement from the tribunal’s chairman justice Augustino Ramadhani said that Baraza will be served with a notice to appear on a day next week.

Justice Ramadhani however said in his statement that the hearings will be in private unless the DCJ opts for a public hearing.

“The tribunal met on June 7 and was of the opinion that preliminary work necessary for the commencement of hearings is almost complete. The Hon Lady Justice Baraza will now be served with the Notice of Hearing within the week commencing on 11 June,” read the statement on Friday evening.

Justice Ramadhani insists that the tribunal has made great strides in preparing for the hearings including gazetting the Tribunals Rules of Procedure on April 20.

In March, the High Court ruled that Baraza must face a tribunal set up to investigate her conduct following a suit by the DCJ who argued that she would not get a fair trial before the tribunal.

Justices Mohammed Warsame, Hellen Omondi and George Odunga observed that the tribunal would give Baraza the opportunity to defend herself following an alleged assault against security guard Rebecca Kerubo in Nairobi on New Year’s Eve.

“Having considered all the grounds raised by the petitioner and the response by the respondents, we think that the issues raised cannot entitle the petitioner to the orders sought,” the judges said adding that the Judicial Service Commission did not commit any errors or omissions in the manner in which it conducted its inquiry which recommended establishment of the tribunal.

The seven-member tribunal comprises Augustino Stephen Lawrence Ramadhan, a former Chief Justice of Tanzania, as chairman. The members are Prof Judith Mbula Behemuka, Justice (Rtd) Philip J. Ransley, Surinder Kapila, Beauttah Alukhava Siganga, Grace Barbara Ngele Madoka and Prof Mugambi Jesse Ndwiga Kanyua.

Lawyers Valeria Onyango (Lead Counsel) and Gideon Solonka Kilakoi (Assisting Counsel) were appointed to back the tribunal.
