NAIROBI, Kenya, May 13 – A woman who admitted to killing her husband earlier this year has been sentenced to three months in jail, because she is pregnant.
High Court judge Muga Apondi said on Wednesday that Florence Gathoni, who admitted to killing her spouse at Thome Estate in self-defence, should be locked up for three months as she is 19 weeks pregnant.
“Were it not for the pregnancy the court would have preferred a longer sentence,” said Judge Apondi.
He however declined to grant Ms Gathoni a non custodial sentence saying ‘justice must be seen to be done’.
Ms Gathoni, a former secretary at a Tobacco firm in Nairobi, had told the judge that she stabbed her late husband of 10 years Brian Karanja on the neck using a kitchen knife on January 10 2009.
On the material day, the court heard that the couple was drunk and a quarrel ensued, after Ms Gathoni accused the deceased of having an extramarital affair.
She explained to the court that when the deceased slapped her, she ran to the kitchen and took a knife to defend herself. In the process, the deceased fell on the knife and later succumbed to an injury that he sustained on the left side of the neck.
During mitigation, Ms Gathoni asked the court to grant her a non-custodial sentence saying she discovered while in remand custody that she is pregnant.
Justice Apondi said that he had received a medical report from Kenyatta National Hospital confirming the pregnancy.
Ms Gathoni pleaded that she needs her freedom to take care of her siblings and some in-laws.
