EABL and Keroche in court over Euro bottles

NAIROBI, Kenya Dec 31 – Two top beer manufacturers are in court fighting over the use of brown bottles.

Keroche Breweries Limited has accused East African Breweries Limited (EABL) for claiming ownership of its bottle commonly known as Euro bottles.

The company through lawyer Irungu Kangata told vacation judge, that EABL has caused the arrest of its distributors and staff which is contrary to the law.

Keroche is now seeking an injunction to stop its competitors from harassing its distributors.

Justice Grace Nzioka, directed that parties file their documents and the matter be heard on January 3.

EABL through lawyer Karori Kamau has filed a preliminary objection to the application seeking an injunction saying that the court lacks jurisdiction to entertain the suit.

The objection will be heard first as the court makes a determination on grounds that there is another suit filed by Keroche.

That application is pending for ruling before another judge, Karori told the court.
