NAIROBI, Kenya, Mar 14 – A businesswoman is seeking to invalidate an executive order that created Nairobi Metropolitan Transport Authority.
Wanjiru Gikonyo says the Authority which became operational in 2015 is unconstitutional and should be suspended.
She has named Transport CS, Nairobi, Kajiado, Murunga, Kiambu and Machakos Counties as respondents.
Gikonyo has faulted the legal notice creating NAMATA because it reduces County revenue.
Gikonyo claims the legal notice issued last year provides for financing of the joint authority in a manner that may affect counties other than ones included in Nairobi Metropolitan.
“The order creates a third party at the table of division of revenue which isn’t provided for by the constitution,” she states.
In addition to the five counties, NAMATA also comprises Permanent Secretaries for Housing and Transport Ministries is in charge of roads from the five counties.
All issues relating to transport for the said counties such as parking and an integrated transport system will be under NAMATA.
Gikonyo is seeking suspension of NAMATA on grounds that no element of public participation was involved .
