Director General Francis Wangusi will now resume his duties until his case is heard and determined/FILE
NAIROBI, Kenya, Jan 31 – The Employment and Labour Relations Court has ordered that the Board of the Communications Authority of Kenya reinstates Francis Wagusi as Director General.
The court has observed that the Authority’s Board was improperly constituted when it sent Wagusi on compulsory leave.
Wagusi, through his lawyer Tom Ojienda, argued that the suspension did not adhere to the Authority’s human resource guidelines and that the board did not have a substantive chairman.
The court has issued an order prohibiting CA’s board, management or employees from harassing, investigating or interdicting Mr. Wagusi until the matter is heard and determined.
“A conservatory order is hereby issued prohibiting and/or restraining the respondents, their representatives, employees, servants or agents or anybody working under or for them from harassing, intimidating, threatening, investigating, dismissing, interdicting, discussing, suspending, passing decisions and in any other way interfering with the Petitioner’s employment until the hearing and determination of this application.”
The matter will be heard on 12th of February 2018.
