Kenyan parties differ over draft

NAIROBI, Kenya, Mar 11- The Party of National Unity is now pointing an accusing finger at its coalition partner saying it is frustrating efforts to reach a consensus over the proposed constitution.
 
PNU says Orange Democratic Movement head Prime Minister Raila Odinga is sabotaging the process of consensus building and scuttling the efforts.

In a statement read on Thursday by Tigania East MP Peter Munya the party said Parliament must be allowed to discuss the proposed Constitution and reach a consensus before the referendum. They proposed that Parliamentarians go for a retreat next week to debate the draft and help them reach an agreement to avert a repeat of the 2005 referendum outcome.

“In view for this need for consensus therefore it is still our considered view that another meeting of the entire Parliament must be organised before the draft is debated on the floor of the House. It has been a tradition for Parliament to go for a retreat to build consensus among the political class,” he said.

Mr Munya also maintained that the only way a new Constitution could be mid-wifed was through a mutual understanding between the two sides of the political divide.

“A majority of Members of Parliament in ODM and PNU share this view. It is only a small clique in ODM who are doing everything to stall the process. Until all MPs are happy with the draft and until all Kenyans are happy with the draft, it is not possible to impose a minority view on everybody else,” he said.

He further warned the political class to stop using the constitutional review process as a means of preparing themselves for the oncoming general elections saying it would divide the country.

“Let nobody think that this process can be a way of organising yourself to take power. It is a document to build the stabilities of the entire country where every Kenyan must be satisfied,” he said.

The MPs also took issue with allegations that Parliamentarians would maim the proposed Constitution once it fell on their hands. They maintained that Parliament was the national body mandated with the responsibility of amending laws arguing that Parliament was not a rubber stamp.

“When you hear people saying MPs are going to mutilate the draft are you saying the CoE, a committee that was appointed by Parliament is more important than Parliament in terms of carrying Kenyans’ views? Are you saying people who are elected into Parliament do not carry Kenyans’ views? That it is only people who are brought from outside who do not have a mandate from anybody who carry their views? Let us not be dishonest about this process,” said Mr Munya.

PNU Vice Chairman George Nyamweya explained that it was not right for Parliament to pass the draft without scrutinising it.

“Parliament has an independent right to look at the document and if need be change so it is not that we are just simply required to say ‘here it is pass it’. That is not the work of Parliament,” he said.

Mr Munya further argued that all the other bodies that played a role in the development of the proposed constitution had to go for a retreat so as to fulfill the task placed ahead of them.

“Just like the CoE went into a retreat to make the draft and just like the Parliamentary Select Committee we intended to go for a retreat to debate it without the procedures of Parliament that are very restrictive; in an atmosphere that is free so that people can ventilate and debate freely to be able to build consensus. The issue of the constitution is not about satisfying one party; it’s about all Kenyans,” he said.

Mr Nyamweya also added that the coalition party would continue campaigning for a consensus over the controversial issues of the proposed Constitution saying Kenyans deserved it. He said it didn’t matter where the MPs retreated to as long as they reached a mutual agreement over the draft and that the party would also continue fighting graft.

“We are asking Kenyans to remain calm because those few who have issues with the conflict cannot stop us. You remember yesterday we had the corruption issue and we know that that is what angered some of us to the point where they saw it fit to derail the consensus building efforts,” he said.

“It doesn’t matter who has been implicated in corruption scandals. We will continue following them up.”

PNU should stop taking Kenyans for a ride. What we want is a new constitution. The previous efforts for Kenyans to have a new constitution failed because the draft was taken to Kilifi and Naivasha where it was changed to satisfy interests of few individuals. PNU can use Parliament to build consensus instead of insisting to go to Naivasha. We should let the document presented by COE pass without amendments as they don't belong to any party. PNU should respect the wishes of Kenyans and know we are not making a constitution for Raila. Some of us are dying for that clause of dual citizenship and others. OJ

I think it is high time for PNU to sober up and look at this issue with a lot of concern. Surely why are these MPs dying to go to Naivasha? Why must Nyamweyas and Munyas stress Kenyans about Naivasha retreat? I dont really understand these MPs. Anyway, I call upon all Kenyans to be alert and beware of our MPs otherwise we are going to get nothing in the end.

oh!!! my God.That was Kimunya and nyamweya?i wanted to make some comments but icant react to their statements.whenever this two open their mouths it confirms to me what i already suspected.......that they have nothing between their years.not even if they went to school.

How contradicting these PNU MPs are! the other time they were saying they dont want an executive PM elected by some 210 or so and now saying they are reprentatives of the people! when did they realise this? if they remove the RECALL CLAUSE then the whole draft is as good as mutilated! if this is the consensus they want,then to hell with the animal that is consensus!

Kenyans there is nothing wrong with Kenya or the current constitutional debate, What is prevailing are deep interests. There is nothing untoward in the draft constitution but deep seated interests of the holders of power and pretenders to the throne. Why do African politicians crave to dominate all aspects of there opponents and subjects' lives? It is the season of lies distortions and half truths. Even if the draft constitution was to pass as it is today nobody would die, ODM wont be in power, PNU wont lose power neither will the population of Kenya increase/decrease. No Muslim is going to declare Kenya a Muslim state. No! no! abortion will not be our way of life it will thrive in the shadows, prescribed by quacks and performed under the cloak of secrecy spurred my the necessary ingredient-Greed. Even if you added the numbers of Senators the Sengwer,Suba, Kuria, Rendille, Elmolo, Iteso, Talai, Shirazi,Yemeni, Europeans,Tachoni and many others wont be represented in the parliament let alone senate. No thing will Change!

PNU is not the commander of ODM and again PNU is not the government of Kenya,,deceiving RUTO and hungry RV MPS to compromise with tribal arithmetics wont wash.

Munya i'm ashamed to have you as my MP in Tigania East. Are you forgetting Tigania and wider meru community dont play the same tune with other tribes that tend to recycle same useless Mps again and again. You will definitely be the statistic come the next general election. I'm very certain you will be voted out and no doubt. I have more respect for COE than the current Mp's coz they hardly know to check things in detail. Why did the Mps fail to detect errors in the supplementary budget read by Uhuru Kenyatta. Why should we trust you now with a more a moe complext project ----- constitution of kenya. We want men and women of integrity to be elected in senate who will veto stupid bills passed by useless bunch of greedy Mps.

munya and nyamwea are dishonest to kenyans. let us tell them to stop taking us for granted.this is all kenyans constitution and not for them and their families.can you close your beaks, you munya and nyamwea.we as kenyans are fully awake of your schemes and straight tell you on your faces that we don't need you. don't you get satisfied with the much you have eaten with your big bellies and pity the poor taxpayers and spare them a penny?

Come on Mr Munya! It's a bad tradition that MPs have adopted lately of going on taxpayer funded retreats when they can discuss everything in Nairobi openly! Who's preventing them from forming a consensus without an expensive, vote buying retreat? If you're paying any attention, Kenyans trust the final CoE draft more than MPs who've proved many times over that they're short sighted and cater to their class interests alone. The MPs want to maintain a grip on power without a challenge from the Senate because most are nothing but tribal or clan chieftains and cannot be elected district wide. Kenyans, the CoE and other progressive minded MPs, including most from PNU, should defend the current draft with their blood! The time to defend Kibaki interests are over, it's time for Kenya. A careful scrutiny of the final draft shows it largely reflects the opinions of Kenyans, despite some changes most of us would want, including reducing number of MPs, having the AG elected, a jury system, a county justice system, confirmation of all judges and parastatal heads etc. Raila has no advantage in the CoE draft. The requirement to consult the PM is temporary during the transition, and is consistent with the current Accord. Other protestations like the Kadhi courts and abortion issues are tempests in a teacup orchestrated by an intolerant few; they should pay attention to what's happening in Nigeria right now, or better still across our neighbours in Somalia and Sudan. It's time for a vote, not more Naivasha Amendment trips! God bless Kenya

'those few who have issues with the conflict cannot stop us' These words seem to describe those few as PNU not ODM. PNU arguments in this case seem self-contradictory

What beats me in this case is why we should have two bodies work on the same draft. If parliament is more competent and more representative than CoE as claimed by Munya and Nyamweya, then why was there need to set up CoE in the first place?
