Kenyan Transport Minister loses poll petition

MOMBASA, Kenya, Feb 5 - The High Court in Mombasa has nullified the election of Transport Minister Chirau Ali Mwakwere as the Member of Parliament for Matuga constituency and ordered a by-election.
 
Immediately after Justice Mohammed Ibrahim’s pronouncements celebrations rent the air at the fully packed courtroom.

Justice Ibrahim ruled that Mr Mwakwere was not validly elected during the 2007 General Election. In his conclusion of a 93-page ruling, the judge noted with concern that Form 16 A was not filed in Kombani ‘A’ and ‘B’ polling stations, where Mr Mwakwere’s challenger Hassan Mohamed Mwanyoha led with 452 votes.
 
The judge said that had the 452 votes been added to Mr Mwanyoha’s tally, then he could have won the election with 9,090 votes compared to Mr Mwakwere's 8,738.  Earlier results had shown that Mr Mwanyoha had trailed Mr Mwakwere with 8,638.
 
Justice Ibrahim said that election rigging clearly showed that Electoral Commission of Kenya (ECK) deserved to be disbanded, as it was a contributor to the chaos and mayhem that followed the election of 2007.

Mr Mwakwere becomes the third MP to lose his seat in the 10th Parliament which has only sat for two years. In December 2008 Joel Onyancha’s tenure in Bomachoge constituency was nullified by the High Court and he lost the subsequent by-election.

Last December, Trade Assistant Minister Omingo Magara lost his South Mugirango seat after Justice Daniel Musinga ruled that the election was marred by irregularities.
 
In Mr Mwakwere’s case, a voter in Matuga Ayub Mwakesi had moved to court to petition the election. Mr Mwakwere was represented by Alfred Mabeya while Balala Mohammed represented Mr Mwanyoha.
 
Justice Ibrahim ordered that the Speaker of National Assembly Kenneth Marende be served with the ruling alongside the Interim Independent Electoral Commission for the latter to proceed to conduct a by-election as required by the law.
 
Mr Mwanyoha said justice had finally been done after two years of struggle and trial. He said he would start campaigning immediately and asked his supporters not to be intimidated by his challenger.
 
Mr Mwanyoha who vied the election on an ODM ticket was flanked by the party’s National Organising Secretary Ali Hassan Joho and vowed to mobilise resources to ensure the party got "what belonged to them".
 
Mr Mwakwere who earlier arrived in his private car did not give any interviews and left immediately in a convoy of 10 vehicles.

May be be the judges can help run the executive- A President in perpetual fear of the people he appoints. Mwakwere ruined foreign affairs,then buried Transport ministry- But Kibaki cheared him on. Thank you judiciary- So it is true there are some very good apples in there among the most rotten ones!!

This goes to show that in the year 2007 elections there was no out right winner since both ODM and PNU have lost seats after opponents went to court to challenge the results.So all those who participated in post election violence,it was all a waste of time.

Good riddance to Makwere rubbish. We need a toast to that. Can Michuki hold two Ministries? He is doing a great Job at Environment but we need Michuki rules back into implementation ASAP-Matatu,Alcoblow etc.

Atlast justice has been done. Makwere deserved it. Most of the Ministers in the former parliament were irregularly elected. They were all meant to be shown there door due to their arrogance and underperformance. Bravo Justice Mohammed for your well thought and historical judgement. I think you should be spared the vetting process come the new constitution.

May I request President Kibaki to appoint Hon.Michuki to Transport.Kenyans now appreciate Michuki's contribution to this beloved nation.Infact the president should combine transport and security dockets and give Michuki.If we could have 3 Michukis and 3 Railas then we do not need 40 ministers.Kenya government will run effectively.We need public servants not bosses.We must learn from Rwanda and borrow a leaf from Kagame's effectiveness in good governance.Michuki, please take the two dockets.

Haiya! One thing is clear - a substantial number of Kenyans will not miss Hon Mwakwere. But lets not forget that he lost Matuga, not because of his \"tutakujengea choo kila pahali anapotaka\" remark or because of the chaos in the transport industry but because of a bad electoral system. I can bet that were the election petition courts to vet all the 210 Constituencies, non would be found without some form of problem ...

This is very sad news for Kenya. How can we lose such a competent, hardworking and innovative Minister. He was the only who cared about poor people by suggesting that they pay a meagre 1/= for Ferry Services. Kenya shall miss his services. Mwakwere,do not worry you will bounce back. In the meantime, Baks will keep for you your cabinet seat however long it takes. Take heart brother

We need a visionary minister in the transport sector. Having Makwere who has vested interest in the sector is not good for the country and the transport sector. Kibaki should listen to what kenyans are saying and not the advisors who seems to be out of touch with the common mwananchi. Let judges rule cases without external interference and it will deter any further riggings in the future elections -- saitoti, Bishop Wanjiru, ANyang Nyong'o n entire Nyanza province should be smelling a rat.

For this one we can plead with the CoE not to subject the presiding judge (i here he is called Juma)into vetting even with the coming constitution. The minister has greatly let us down in the transport ministry.

If at all the rest of the judiciary guys could act with integrity like IBRAHIM(Mombasa Court and Musinga( Kisii high court) then at least we can have some faith it. Makwere should be an example to the rest of leaders like him cos come 2012 whomever will try to Rig the polls we Kenyan( Voters) we shall sent them home by force. Congrats MR JUMA MAKWESI for the decision you meant. We need many Kenyans like you.

This ought to have hapened last year,i'm so excited about it. Raia Ali Mwakwere is not worth being aleader coz he's arrogant,ineffective,highly educated but not learned. He's wasted taxpayer's money doing nothing as Transport minister. This is the beggining of his political death knell.
