Kenya defends rejection of ICC trials

NAIROBI, Kenya, Nov 6 -The government has defended its move not to refer the trial of post election violence suspects to the International Criminal Court (ICC) saying this was guided by the desire to ‘safeguard’ ongoing institutional reforms.
Justice and Constitutional Affairs Minister Mutula Kilonzo said on Thursday that a self referral was likely to receive some resistance from a section of Members of Parliament further undermining the pace of reforms. Mr Kilonzo said the decision was unanimous within the top leadership and was based on the desire to sustaining the pace of reforms which has lately hastened.
“There are so many commissions that are undertaking critical institutional reforms and by self referral, you want to mean that you want to wish away some Kenyans (MPs) who will be useful in participating in those processes,” he said.
After a two hour meeting with Chief Prosecutor Luis Moreno Ocampo on Thursday, the government declined to commit a hand-over of the trials to The Hague-based court, but instead said it “would work with the court within the Rome Statute”.
President Mwai Kibaki and Prime Minister Raila Odinga said the government remained “fully committed to discharge its primary responsibility in accordance with the Rome Statute to establish a local judicial mechanism.”
“I am satisfied that the government is right not to make a self referral but to leave the Prosecutor to do it on his own motion because he has a lot of power within his mandate,” said the Justice Minister who has openly said that he would want to see warrants issued before Christmas.
The government also rejected a proposal to allow the ICC to conduct trials in Kenya on fears that this could compromise national cohesion.
“I cannot allow prosecutions to be taking place probably in Mombasa whereas the public mood is, ‘Don’t be vague got to The Hague’.... no way” he said.
A self referral, Mr Kilonzo added, could also be challenged by suspects under the Rome Statute.
“Article 15 of the Rome Statute states if the prosecutor succeeds in convincing the pre-trial chamber no one can challenge that ruling,” he said.
Mr Kilonzo however reiterated that all was not lost in the search for justice despite two unsuccessful attempts to set up a local tribunal. Mr Ocampo said he would be moving to the pre-trial chamber to seek approval to commence investigations.
“Its going to be heavy duty from December and nobody should think it is going to be picnic time,” Mr Kilonzo said.
Central Imenti MP Gitobu Imanyara is still pushing ahead with a Bill to set up a local Tribunal which is widely expected to deal with majority of the post-poll offenders. It is likely that only two or three people will be indicted by The Hague with suggestions that they include Cabinet Ministers who were implicated in funding or organising the mayhem. |

| This is the most naked hogwash i have heard from Mutula Kilonzo. Please Mr Mutula can we know your stand at one minute you want the culprits dealt with the next you are protecting them in the name of national cohension. for the record these thugs should be prosecuted whether here or the Hague and we are ready top deal with the aftermath.this nonsence of threats that if so and so are held there will be chaos is a blatant lie perpertuated by selfish politicians, we dont want murderers for leaders period. |

| Reforms in this country will never occur overnight.our legislature is so immersed in cut-throat political iniquity and corruption of yesteryears that keep mutating and begetting new ones. With time however all the seeds will wither and die when kenyans bring a coruption desert by voting in untaintd persons. Ocampo may not deliver us but he can help remove the highly prolific coruption clowns. |

| Every kenyan has what is referred to as 'SPECIAL INTEREST' in any case of national interest be it political, economical, social or even spiritual nature. Kenya is not a value based system. Our judgement on any national issue is viewed through an ethnic prism and on the basis of us versus them and not of the basis of universal good against bad.Who is unblemished in the kenya societal realm?Everybody has his share of skeletons that we would better not open any cupboard.This is the catastrophe of this 'country' called Kenya. Somebody or event would need to save us from ourselves. |

| We just need fresh blood to run this country. If we take a critical look, the current leaders are almost everywhere. Anlo-leasing, Goldenberg,GrandRegency, post elections, and so on.So whatever they do be it constitution making they'll be favoring themselves and we will have minimal or no changes at all!. cnt just an Obama rise in Kenya and be voted for? |

| i don't kenyan government should e trusted to handle such serious matters. kenya has been known to be a corrupt country and therefore the post election victims will not receive justice. on the other hand why did the government close the IDPS camp when mr ocampo said he is coming? are they trying to bloke the IDPS from talking to ocampo? this are some of the many issues why the government cannot be trusted. |

A killer must face the law irespective of his (MP) status. They masterminded the killings, Period. Mutula should spare Kenyans this legal jargon and admit that they are shielding their cronies from ICJ. But for how long? |

| This is just a load of crap. In directly they are saying they know that amongst them there a criminals but because of other "agendas" they should not to be referred!
I am not saying that the reform process in not important but the same people who got a 1,000+ Kenyans killed and other 10s of thousands displaced are the same people writing the new constitution! That is not acceptable.
