Kenya cemetery row rears its head

NAIROBI, Kenya, Mar 9 - The government was on Tuesday put on the spot to explain why a “senior Cabinet Minister” and City Mayor Geoffrey Majiwa were still in office despite being adversely mentioned in the fraudulent purchase of a cemetery plot.
Subukia MP Nelson Gaichuhie sought a Ministerial Statement in Parliament from the Minister for Justice to explain why no action had been taken against the two despite being indicted in a report by the Kenya Anti Corruption Commission.
Mr Gaichuhie claimed that the report had accused the Minister of receiving Sh59 million of taxpayers’ money while the Mayor got Sh11 million in the Sh259 million scandal.
“The Minister should explain the role of Newton Osiemo who, according to the report, represented the interests of the said Minister and received Sh59 million on his behalf,” he said.
“Now that the two are being investigated by KACC, the Minister should confirm when the two are going to step down in line with the remarks of the Prime Minister that the war against corruption must be personalised.”
On Monday, President Mwai Kibaki interdicted 13 civil servants over the matter and ordered the immediate prosecution of the officers and the recovery of the funds.
The action followed recommendations by the Controller and Auditor General Anthony Gatumbu and the Departmental Committee on Local Authorities.
The government auditor’s report released to Parliament last week implicated the officers accusing them of overvaluing the proposed cemetery land. It said the officers ignored a valuation by the Ministry of Lands which quoted the market price for the 120 acres of land at only Sh24 million.
The reports called for disciplinary action against the officers who were involved in the procurement and those who perpetuated the overpayment and quick recovery of the lost funds.
There was heated debate in the House over whether the Ministerial statement could be delivered yet the MPs hadn’t discussed the two reports.
“The statement makes allegations about reports that are not before this House. If they have allegations then they should table them,” argued Industrialisation Assistant Minister Nderitu Muriithi.
“Can we allow this House to debate the reports then if there is any supplementary questions then they are answered then,” urged Immigration Minister Otieno Kajwang.
Deputy Speaker Farah Maalim however ruled that the statement was legitimate and ordered that it be delivered next Wednesday.
“The report does not in any way take the responsibility of the government to Kenyans to perform its duties in a transparent and corruption free manner,” ruled Mr Maalim.
The plot was meant to be an alternative for the inadequate Langata Cemetery. According to the audit, Sh175 million went to other parties but not the vendor of the land in Athi River who on his own, cooled his heels with Sh105 million.
In its report the Departmental Committee on Local Authorities had besides the suspended officers called for Local government Minister Musalia Mudavadi and Mr Majiwa to step aside.

| It seems Bw Mudavadi received his share by proxy, and that too is corruption. Even if he keeps on saying that he initiated investigations, it does not make him a Mr. clean . He may have done so thinking that he had covered himself fully in a way that he would not be exposed but alas! the seal is broken. Palipo na moshi pana moto pia. |

The guys should be locked in prison and the keys thrown into the sea.

Can s/one confirm that the awaited ferries are true or we r waiting another scandle. It seems every one is trying to have his/her share be4 new constitution is passed which has abortion scandle.

| There is no point sacrificing the small fishes while leaving the BIG ones to raom aroung untouched. Why should junio officers face the sack while senior officers go unquestioned. We have witnessed Permanent secreatrys and some junior officer suspended for allegedly being corrupt, what about cabinet ministers in these particular dockets. Between Minister and P.S who is the senior most? Is it the fight against graft being too personalized or alternatively being fought along political affiliation? |

| now i fully understand the actions of DPM: Remember he was very impatient to tell us that he has asked the PS to step down: the idea was to forestall and preempt any further revelations. its clear that they had all conived (even with the ps) to have the ps sacrificed to save the DPM. i think they were still procastinating when the explosion hit.. apparently it has backfired and now they have ordered the lawyer-thief newton osiemo to disappear; i really pity them..the case is still too hot and fresh and we shall chase them to the end of the earth..regardless of tribe or ODM, PNU..look at the beneficiaries..they received the loot as INDIVIDUALS and NOT tribes |

| Its a pity that our leaders say one thing and do another. Corruption is corruption at whatever angle we look at it. Kenyans should now insist that those found guilty of corruption take up their responsibilities and quit. They have to be prosecuted and all the monies embezzled by them taken back. on top of it all, they have to pay the ultimate penalty of stealing and should never at any time be entrusted with any responsibility. Any rational person can not support corruption along tribal or political lines. Lets save our beloved country from such calibre of leaders. |

| Sadly, we will see the same tribal conclaves coming to the defence of their 'son'! Just on Monday the PM said that the fight on corruption has to be personalised, and its politicians who cause it, in essence rebutting the Presidents comments that we should not policitise and personalise corruption, what we get now is silence from the PM... KACC for the first time has a well chronicled report on this scandal ( surprisingly), questions that need to be answered are; who is Newton Osiemo, however much the DPM complains, everyone who knows Mr Osiemo know of his very close relationship to the DPM, 2. If he wasnt acting as a proxy for someone, who was he acting for and did we just give him 59million of tax payers money? Mr Majiwa, what are you still at CCN? I challenge both ODM n PNU to face up to this, something just doesnt add up Mr DPM...I can see Ruto smiling...:) |

| The most honorable thing the minister for Local Government Hon Mudavadi ant the city of Nairobi mayor Mr. G. Majiwa should do is to step a side without being pushed into doing so. I believe the Cemetery case is just the tip of the iceberg. There must be a lot of corruption at the City Hall. |

| Now we want to see if kibaki and Raila are committed to fighting corruption. I can see why Kibaki did not fire Mudavadi and the Nairobi mayor. If he did he could have been asked to fire all ministers involved in previous scandals. Now the have adopted principal of covering ones back when in trouble. Kenya has no future if this is the kind of political leaders we have and thats why we cant eliminate tribalism, "Our time to eat". |

| If anyone thought that this KKK thing is a joke, they ought to think again. This dragon is real and has been unleashed on ODM. It going to conseme the party to its core. Hey Bw. Musalia, weka chako kichwa maji sasa. It is your turn kunyolewa. You slept on the job, and you have to answer a few questions. Unfortunately, because of bad politics of ODM and PNU, there will be no merit in the discussions to this issue. You will be hauled out of office by the sharks in parliament. If I were you, I would read the signs of the day like Karua did and vacate before the humiliation. |
