Kenya PM stands by besieged deputy

NAIROBI, Kenya, Mar 10 - Prime Minister Raila Odinga has defended his Deputy and key political ally Musalia Mudavadi over his alleged involvement in the multi-million shilling cemetery land scandal and shrugged off resignation calls saying “the government was still consulting on the matter.”
Mr Odinga told Parliament on Wednesday that a report by the Kenya Anti Corruption Commission had clearly stated that investigators had not been able to ascertain a claim linking Mr Mudavadi to the scam, adding that Newton Osiemo who is alleged to have acted on the DPM’s behalf is missing.
“They have also stated clearly in their report that they had not taken a statement from the Minister,” said the Prime Minister (Mr Mudavadi was however interrogated by KACC detectives on Wednesday).
The KACC report quoted the suspended City Director of Legal Affairs Mary Ng’ethe saying that Mayor Geoffrey Majiwa introduced Mr Osiemo as a business associate of Mr Mudavadi. It was claimed that Mr Osiemo was “to take care of the interests of the Minister and his Permanent Secretary Sammy Kirui.” The report added that Mr Osiemo received Sh59 million in the transaction which was unaccounted for.
The Premier who controversially suspended Ministers William Ruto and Sam Ongeri a few weeks back instead urged Kenyans to exercise patience and wait for the outcome of ongoing investigations into the scam
Mr Mudavadi on his part read ‘political mischief’ in the matter. He wondered why the report by KACC was leaked to the media and also circulated to MPs with the page where he was mentioned “circled for members’ attention.”
“People should be tabling a cheque to show I received the money,” he said, while reading a Personal Statement in the House.
Mr Odinga on his part used his allocated time in Parliament to detail out the measures the government was taking to address corruption. The debate went on for close to three hours with tempers flaring in the House as members accused the government of failing in the fight against graft.
“When you steal you are arrested. There is no need for consultations. Now I appears if you steal mangoes there will be consultations,” Yatta MP Charles Kilonzo told the House.
On his part, Ikolomani MP Bonny Khalwale wondered: “Is the government sacrificing civil servant for politicians while we all know that they only act in collaboration of their ministers?”
A section of legislators raised issue with Mr Odinga’s stand on graft accusing him of doublespeak when it comes to ministers from his political party.
“You suspended Ministers Sam Ongeri and William Ruto on the basis of investigations that were being carried out. You were asked whether your Deputy will step aside as investigations are been carried,” charged Nominated MP George Nyamweya.
Members wondered whether the disagreement between the PM and President Mwai Kibaki on the earlier suspensions was a hindrance to the fight against graft.
“I cannot suspend another Minister when we are still in consultations on the other suspensions,” the PM admitted.
Garsen MP Danson Mungatana and his Ikolomani counterpart Bonny Khalwale said there was need for all those mentioned in graft to step aside pending investigations.
It is alleged that the involved officers overvalued the cemetery plot by Sh259 million. The plot was valued at Sh24 million but Sh283 million was paid out. President Kibaki on Monday suspended Mr Kirui and 12 other officers linked to the scandal.

| Why is Raila keeping quit on the matter? what happened to Ruto and Ongeri? do we really have leaders with leadership qualification in Kenya or they are just leading for the sake of it? corruption is corruption whether Raila tries to baptise it or not period. Raila should behave! |

| Kenyans i wonder where our integrity and common sense is. this is not about individuals especially raila but its about us and our future generations well being.Nowadays any thing goes wrong .. raila name has to be mentioned. is he an angel, devil or what? why all this hatred? i look forward to the day raila would wake up and announce that he is out of politics. just imagine how pnu and all his haters would miss him, kenyans remember you dont know what you got till its gone. lets preach love as its said in the holy book 'love your enemy' instead of payukaring hatred.cheers |

| There are no double standards that the PM is applying. One let us look at Ruto's case...he was directly involved in the maize saga because he influenced the sale of maize to a disabled person, he accepted that. Secondly, let us look at Ongeri's case...he publicly declared that he had to alter the arithmetic that went with the distribution of the FPE in the province to suit the smaller Kisii region. Now let us embark on Mudavadi...there is no evidence that has linked him to the sale of the land. In fact, the alleged point man has come out in public to denounce the allegations that he is an associate of the DPM. |

| I have just been curious to on the Kshs. 24m value the press has been quoting to be what the land worth, translating to 200k per acre! 50 by 100 (one eighth) plots in that area go for 350k. Moreover, the Government valuer is yet to do valuation of land. Where did the Kshs. 24m come from? |

| first and foremost, get hold of this Osiemo guy and question him properly, to get the truth. I believe Mudavadi has no connection to this matter at all. Mudavadi early before the story even hit headlines, asked for the suspension and interogation of his PS, a mR Kirui. Last year when The Standard newspaper highlighted this issue, even Majiwa had no knowledge of the scandal. Lets wait for investigations before we crucify any of this guys. |

| There is absolutely no smoking gun here to implicate Mudavadi and why the hell are the reports circulated to PNU mps first with mudavadi's name circled?
Is Kacc a tool of certain individuals? officilas who circulate incomplete reports are better judged as incompetant and should go home.NSIS and KAcc just like the administration ploice during in the run up to not bungled but rigged elections,are behaving like operatives of political parties and not the State.Mbio za sakafuni huishia ukingoni,when u try to set up some one pliz be thorough,KAcc and Pnu just goofed this one.Ukweli utadhihiri na urongo utajitenga |

| Corruption has rigged us our rights and made the poor more poorer and the rich(of course with ill gotten wealth)richer. We are all presumed innocent till proven guilty. As much as I am of the opinion that all these people( who have ever been mentioned in corrupt deals)might be innocent, its only fair that we be principled enough and agree on whether to step down once suspected or once found guilty. We should consider though that when left in the office once mentioned, the evidence can be manipulated given the power still vested on the suspect; But again if we settle for a suspect to leave office to allow investigations, the opposing parties will carry their vendetta a notch higher and mention their opponents names even if not involved.
Is it not true that even in our system suspects are detained to gather evidence and be declared guilty or innocent. This can only mean one thing, that even the so called big fish have to face the same law, unless it can clearly be stated that we are governed under different laws. It's clear that our leaders are trying to show us that we are Kenyans-Yes , but some are more equal than others.
Hon. Raila stated so well that he on suspending Ruto, it wasn't that the guy was innocent but the reason was to pave way for investigations and once found innocent would resume office. Hon. Raila tell me if the two cases are different in any way, all I know is that they have been mentioned in corruption so should be treated equally. I believe in Hon.Mudavadi's innocence, but please stop showing us that you are taking sides.Be a good leader and show us the way. |

| Newton Osiemo has come out and denied receiving 59 million,he has proof that he refunded 35 million for the land agreement that chege cancelled,KACC did not bother to investigate the allegation aganist Musalia,just hearsay and yet they never question Osiemo,what is motonyi thinking? its common knowledge,you are innocent until proven guilty,its all politics,but it has backfired |

It was so much different when kimunya made 45b (note not lost) for the govt, they were all on the road, FPE was 110m, yet the same cartel was falling over each other to hold press conferences. | Sober up. No one know that Osiemo represented Mudavadi. KCCA is looking for him so that they can ask him that. We blog like we already know the answer. If I commit a crime and say I was send by You (blogger), does that mean you committed the crime? Mps also need to sober up. |
