NAIROBI, Kenya, Jan 21 - Latest reports now indicate that unwanted Jamaican cleric Abdullah El-Faisal is still on Kenyan soil.

Multiple sources confirmed that the Gulfstream jet chartered to transport him to his homeland was still parked on the runway at the Jomo Kenyatta International Airport by 5pm Kenyan time "after it developed a mechanical problem."

"Yes, he has not left after the plane developed a malfunction," a senior government source who spoke on condition of anonymity told Capital News.

The latest information contradicts assertions made in court by senior State Counsel Edwin Okello on Thursday afternoon that Sheikh El-Faisal left JKIA mid morning for Jamaica.

The preacher was due to be produced before court on Thursday morning but the judge in the case pushed the matter to 2.30pm. When the matter came up, the office of the Attorney General asked for about 20 minutes to verify his whereabouts. Later, Mr Okello informed Justice Jean Gacheche that Sheikh El-Faisal was no longer on Kenyan soil.

Mr Okello said: “I have been told by the Anti Terrorism Police Unit officers that the subject is no longer within the jurisdiction of the court. He has left the country and his destination is Jamaica.”

“He left by Gulfstream jet flight number ZSJGC312 this morning.”

Documents produced in court and obtained by Capital News indicated that the preacher checked in through customs and was destined for Jamaica.

His passport shows he entered East Africa through the little known Tanzanian town of Kasumulu on December 9, last year.  He crossed over to Kenya from Horohoro through to Lunga Lunga in the South Coast on December 24.

Sheikh El-Faisal, who was jailed for four years in Britain for inciting racial hatred, was arrested in the port city of Mombasa on December 31 by Kenyan police, who had since tried and failed to deport him twice.

The 45-year-old firebrand cleric\\\\\\\'s arrest without charge sparked an outcry among Kenya\\\\\\\'s Muslim community and protests which left five dead following Friday prayers on January 15.

The high court had been due to decide whether or not to keep Abdullah El-Faisal - who is on several international terror watchlists - in detention.

Earlier on Thursday, the police filed several security documents accusing the Jamaican cleric of engaging in preaching activities that violated the terms of his tourist visa, and of being a national security threat.

The Muslim Human Rights Forum has in the meantime released a statement saying any protest over the cleric’s saga has been cancelled.  Al-Amin Kimathi said no protests had been planned in Mombasa or Nairobi as claimed.

His lawyers led by Haroun Ndubi expressed shock at the turn of events and demanded full documentation including officers who had accompanied him.

“We want to be furnished with documents to show which ATPU officers followed him, who is the pilot, which plane… and such other documents,”  Mr Ndubi told the judge.

Kenyan Foreign Minister Moses Wetangula had said earlier this week that the cleric would be out of the country by Thursday.

Neither Mr Wetangula nor the High Court officials gave any details of the route El-Faisal would take. If headed to Jamaica by plane, a re-fuelling stop in a second country would be necessary.

He is persona non-grata in most Western countries and has been denied transit in several African countries. Kenya\\\\\\\'s two previous deportation efforts earlier this month failed when Tanzania and later a Nigerian airline refused to take him.

According to internet sources the Gulfstream V jet has a range of 6,750 nautical miles (12,500 km), the longest flight range in its class.

The Gulfstream 550 competes against the Airbus Corporate Jet, Boeing Business Jet, and the Bombardier Global Express.

I actually got it wrong --- kenya needs a wall n not a fence . Many many well wishers, NGOs and individuals willing to contribute towards the construction of a great wall on the kenya and Somali border. Kenya army is not prepared to secure the border and i think the wall will do a better. The wall will restrict the people entering n leaving somali and also will limit the movement of fire arms from somali and kenya. If by chance we have cleric Abdullah El-Faisal and the likes kenya will not waste tax payers deporting them but rather throwing them over the wall and that will be the end of story. I sound mean but ........... but what else can be done to Somali.

basically i have no idea why in the first place our brothers r deminstrating over a man who is said to be a threat to us. the govt should just use the police plane to deport him rather than using the tax payers money. the big question on my mind why is the US so quiet on this matter?

Guys, i wanna tell you all something. What really happened is that our goverment arrested Faisal on the thought that they had arrested a most wanted terrorist. However, shock on their side was that the Brits and Yankees were fully aware of his whereabouts and chose to have him do his damage in Africa. The Masters abandoned the servant at time of need. So we were stuck with him. I personally have taken the time to listen to his lectures and hear the alleged hate first hand. What was apparent was that Al Faisal is not a terrorist but one who attracts attention of anyone who shares no love for the slave masters and colonialists. He really speaks his mind no matter the consequences. That is why the CIA and M15 have no crime on him. You cant charge anybody for not liking you and telling everybody about it. Visit You tube for his interview with Hardtalk on the accusations that he calls for mass killings of non muslims. It is a watch. Dont take everything the black (or flat) box tells you.

Kenya can just send this man into Somalia, so he become US problem becoz the usa do not want to deal with him until he has bombed them. Americans by nature are reactionaries and will never act to prevent anything. This fellow is better caged in jamaica, than being left to roam the world and might end up in Yemen, but US is just being silly about him.

What in the world is taking so long? Now the Al Shabab Thugs and goons are seeking to attack Kenya! Mr. Mwai, please please flex the security operandus muscles and throw a few bombs into Somalia, while deportation continues. Kenya CANNOT wait for another August 98. Furthermore, the government has an obligation to protect us!

What the government did by sending the controversial cleric Addullah El-faisal is wrong. There is no way you can solve a pressing issue by avoiding it! Mr. El- Faisal will remain the biggest problem that Kenya will experience in future. Now that the frog has been thrown in water to be drown only to swim a way happily! This is a stab at the back of justice. Too bad.

For sure for sure someone is fixing us. I always have this feeling that Americans and Britons are not our true friends. Is this guy so dangerous that just passing through their countries would harm them. This is not something America and Britain can't handle. As someone suggests here, travel advisories are in the offing and CNN, BBC cameras trained on us. We can't always blame our government. On this one I have started seeing our so called friends in a different light

Lucy, to the Americans and the Brits, reforms are more important than our security! Have you never noticed they talk of 'their' security in Kenya and thus the travel bans! Don't be shocked if they give travel instructions because of the friday skirmishes, you just need to watch CNN, BBC etc.....this guys care less about us and the earlier we realise the better for us!

I still have one question that is bothering me..where is the American govt in all this? Aren't they the masters of 'War on Terror'? They put Al Faisal on that watch list in the first place. Why are they not assisting Kenya get rid of the guy? Can we then assume that they are not as keen as they would like us to believe on fighting terrorism? Faisal teaches about killing the 'Westerners'. Should Kenya take a gamble, sit back and actually release the guy to continue his teaching with the thinking that his teaching will not lead to the killing of Kenyans? After all, strictly speaking, Faisal has nothing against Africans, right? Its time the American govt made known its stands in this whole saga. Otherwise, I starting to think that maybe we should release the guy and give him a job with the Internal Security or Defense Ministries and let the American government worry about having its interests hit by terrorists!

@Ricko, I actually think your idea of securing the border would work. Instead of a fence though, Kenya could build a very high wall to separate that lawless state and Kenya. I mean the Berlin Wall worked right. Why wouldn't it be effective here? Tuanze kuchanga ASAP tujenge hii kitu..

Kamau may just be right:Faisal is still around. The presnt government thrives on deceit: systems not working at borderposts, computer errors at treasury, computer failures at exam council etc.If the prime minister does not take corrective measures, he is the loser in the next general election. The rest of the politicians are dead horses sunk in tribalism. Hear them talk of kkk.Back to faisal: release him, let him preach a couple of days under tight security and ask him to join his muslim brothers in Somalia. Why are we fearing and our master Britain is not helping? Perhaps he was enroute there. To hell with Britain.Moi should remind them that we are a soverign(sp)state. We wont have to charter a plane amid our food shortages which the government has impossed on us.

If i were Al-Faisal,once I get to Jamaica,I would definitely consider a career change.Singing reggae is much more rewarding than preaching hatred. But then again, him being such a radical he will start singing about marijuana.tihi hi hi :-)

Good riddance at last. But the question is have our Immigration and Corrupt police officers manning our entry and exit points learnt any lession? Their act has brought suffering and unnecessary expenditure to the GOVERNMENT.I urge the police to continue the swoop on foregners untill all aliens are deported. That is when our beloved Kenya will experience Peace.

ricko (January 21st, 2010, 3:48 PM)
The kenya Muslim should vet the preachers they invite in kenya to preach. We dont the likes of Abdullah Al-Faisal who are possessed by demons destroying our country. He's a bitter and hopeless man. I hope the Jamaica will try to tame. Kenya muslims have a right to be the country just like any other kenyan but they dont have right to infringe or interfere with rights of other people. We dont want to see lives threatened or property destroyed. Government should lay clear rules of holding demonstration in the country. A stadium should be built somewhere for individuals who wish to hold political demonstrations --- christians, jews, muslims, hindus ...... but we cant allow this menace to continue in this country. Secondly, something need to be done to secure the border btn kenya n somali..... having a fence just like Israel is too a viable option.
