NAIROBI, Kenya, Apr 28 – Bishop Margaret Wanjiru has filed an application in the High Court for bail review, saying denying her freedom is a violation to her constitutional rights.
In the certificate of urgency filed by lawyer Kennedy Ochieng, Bishop Wanjiru wants the stringent bond terms granted to her Friday by chief magistrate Francis Andayi reviewed.
The magistrate had ordered Wanjiru to pay a cash bail of Sh500,000 and in addition deposit two sureties of similar amount.
Bishop Wanjiru can however only secure her freedom on Tuesday after the court agreed she needs to remain behind bars until Jubilee nominations which she was protesting against leading to her attest, are over.
She has gone on to say that the order sets a dangerous precedent for granting orders that were not sought.
“The orders if the trial court infringes on her fundamental rights .They are detrimental to the accused right to a fair trial,” argues Ochieng.
The politician has faulted the lower court’s decision saying it is ostensibly detention without trial.
