MCA withdraws Governor Kidero impeachment motion

NAIROBI, Kenya, Oct 15- Viwandani Ward Member of the County Assembly Samuel Nyangwara has withdrawn a motion to impeach Nairobi Governor Evans Kidero; a few days after court blocked the impeachment process.

The order was issued by the High Court Monday afternoon, a day before he was scheduled to face Members of the County Assembly at City Hall.

The letter dated Thursday was sent to Nairobi Assembly Speaker with the MCA only quoting the provisions of the County Government Act and Standing Orders allowing him to withdraw the motion, without explanation.

The impeachment motion was tabled during a chaotic session last week, although four of the MCAs listed on it later claimed that their signatures were forged and that they were not consulted on the matter.

They include Jeffer Kassam, Peter Njau, Charles Thuo and George Njoroge.

“On 30th of September 2016, I was surprised to learn that my name and signature was among those who had purportedly signed in support of the Notice of Motion presented by the Honourable Samuel Nyangwara on 28th September to impeach or remove from office the Honourable Dr Evans Kidero,” one of the MCA said in an affidavit.

MCA Nyangwara who tabled the motion however insisted that the four were part of the plot and has dared them to report the matter to the police.

Kidero is accused of violating the Constitution by failing to implement the Ward Development Fund.

It required two thirds of the 127 MCAs in the county to remove Governor Kidero from office.

Debate on the motion failed to kick off on Tuesday due to lack of quorum and Magelo had earlier stated that the process would go on despite the court order stopping it.

Kidero had threatened contempt proceedings against the County Assembly should they insist on debating the censure motion against him.

Through his lawyer George Kithi, Kidero stated that he has not yet formally received the complaints levelled against him and as such, he cannot be able to defend himself appropriately.
